  1                      A bill to be entitled

  2         An act relating to patient safety; requiring

  3         the Patient Safety Center at the Florida State

  4         University College of Medicine to study the

  5         return on investment by hospitals from

  6         implementing computerized physician order entry

  7         and other information technologies related to

  8         patient safety; providing requirements for the

  9         study; requiring a report to the Governor and

10         the Legislature; amending s. 395.1012, F.S.;

11         providing additional duties of the patient

12         safety committee at hospitals and other

13         licensed facilities; requiring patient safety

14         officers to make certain recommendations

15         concerning the use of computerized physician

16         order entry and other information technologies;

17         providing an effective date.

19  Be It Enacted by the Legislature of the State of Florida:

20  

21         Section 1.  The Patient Safety Center at the Florida

22  State University College of Medicine, in collaboration with

23  researchers at other state universities, shall conduct a study

24  to analyze the return on investment that hospitals in this

25  state could realize from implementing computerized physician

26  order entry and other information technologies related to

27  patient safety. For the purposes of this analysis, the return

28  on investment shall include both financial results and

29  benefits relating to quality of care and patient safety. The

30  study must include a representative sample of large and small

31  hospitals, located in urban and rural areas, in the north,

 1  central, and southern regions of the state. By February 1,

 2  2005, the Patient Safety Center at the Florida State

 3  University College of Medicine must submit a report to the

 4  Governor, the President of the Senate, and the Speaker of the

 5  House of Representatives concerning the results of the study.

 6         Section 2.  Section 395.1012, Florida Statutes, is

 7  amended to read:

 8         395.1012  Patient safety.--

 9         (1)  Each licensed facility must adopt a patient safety

10  plan. A plan adopted to implement the requirements of 42

11  C.F.R. part 482.21 shall be deemed to comply with this

12  requirement.

13         (2)  Each licensed facility shall appoint a patient

14  safety officer and a patient safety committee, which shall

15  include at least one person who is neither employed by nor

16  practicing in the facility, for the purpose of promoting the

17  health and safety of patients, reviewing and evaluating the

18  quality of patient safety measures used by the facility,

19  recommending improvements in the patient safety measures used

20  by the facility, and assisting in the implementation of the

21  facility patient safety plan.

22         (3)  The patient safety officer must recommend changes

23  in the system of patient care which would be necessary for the

24  hospital to use computerized physician order entry and other

25  information technologies.

26         Section 3.  This act shall take effect upon becoming a

27  law.

 3    Requires the Patient Safety Center at the Florida State
      University College of Medicine to study the return on
