A bill to be entitled
2An act relating to construction practices; providing
3legislative findings and intent; requiring the Florida
4Building Commission to review construction practices and
5building inspections in this state and to make
6recommendations for the improvement of those practices and
7inspections; providing procedures for the review;
8requiring the commission to report to the Governor and
9legislative leaders; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Florida Building Commission review of
14construction practices and inspections.--
15     (1)  LEGISLATIVE FINDINGS AND INTENT.--The Legislature
16finds that due to the rapidly increasing rate of construction
17which has occurred in the first few years of the 21st century,
18the possibility exists for an increase in the prevalence of
19construction flaws and for a decrease in the quality of building
20and home inspections. The intent of the Legislature is that the
21review initiated under this act will produce findings that will
22increase the quality of construction and optimize the
23effectiveness of building and home inspections, while providing
24protection for builders, inspectors, and consumers.
25     (2)  REVIEW PROCEDURES.--Beginning July 1, 2004, the
26Florida Building Commission shall conduct a review of current
27construction practices in this state for the purpose of
28formulating recommendations concerning how to improve the
29quality of construction in the state and how to maximize the
30effectiveness of the building inspections and home inspections
31associated with such construction. The commission shall conduct
32or contract for research that supports this purpose and shall
33conduct hearings and any other activities that the commission
34considers essential in fulfilling this purpose.
35     (3)  REPORT.--By January 15, 2005, the Florida Building
36Commission shall write a report of its findings under this
37section and shall submit copies of the report to the Governor,
38the President of the Senate, and the Speaker of the House of
39Representatives. The report must include any recommendations for
40proposed legislation that the commission considers appropriate
41and necessary.
42     Section 2.  This act shall take effect July 1, 2004.
