4 | Remove everything after the enacting clause and insert: |
5 | Section 1. The Legislature shall conduct an interim study |
6 | of the issues surrounding antiquated subdivisions, and suggest |
7 | statutory and non-statutory mechanisms and incentives to promote |
8 | the redevelopment of antiquated subdivisions in a manner |
9 | designed to meet current planning and environmental standards, |
10 | and promote the marketability of such redesigned communities. |
11 | Any proposals must recognize and maintain the property rights of |
12 | all property owners to provide certainty to property owners |
13 | regarding how property rights will be maintained while |
14 | redevelopment is encouraged and promoted. Antiquated |
15 | subdivisions, for the purposes of this study, shall be defined |
16 | as residential subdivisions created prior to 1980 of more than |
17 | 500 lots, in which little actual residential development has |
18 | occurred and the vast majority of the property is vacant and in |
19 | no productive use. |
20 | Section 2. This act shall take effect upon becoming a law. |

30 | WHEREAS, under the Constitution of the State of Florida all |
31 | natural persons have inalienable rights, among which are the |
32 | right to acquire, possess, and protect property, and |
33 | WHEREAS, no person shall be deprived of property without |
34 | due process of law, and |
35 | WHEREAS, Florida's population growth has resulted in an |
36 | increased need for well-planned mixed-use communities, and |
37 | WHEREAS, many communities in Florida contain antiquated |
38 | subdivision which have failed to develop due to failing |
39 | infrastructure and lack of services, and |
40 | WHEREAS, such antiquated subdivisions are an economic |
41 | liability to their property owners and the communities in which |
42 | they exist, and |
43 | WHEREAS, additional tools are needed to provide the |
44 | necessary incentives and mechanisms to promote the redevelopment |
45 | of such antiquated subdivisions into communities which meet both |
46 | modern standards for land planning and marketability, and |
47 | WHEREAS, any such incentives and mechanisms must recognize |
48 | and maintain existing property rights, NOW, THEREFORE, |
