1 A bill to be entitled
2 An act relating to the Legislative Historic
3 Preservation Commission; creating s. 11.801,
4 F.S.; creating the Legislative Historic
5 Preservation Commission within the legislative
6 branch of government; providing for membership
7 of the commission and terms of office;
8 providing powers and duties of the commission;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 11.801, Florida Statutes, is
14 created to read:
15 11.801 Legislative Historic Preservation Commission
16 created; powers and duties.--
17 (1) There is created the Legislative Historic
18 Preservation Commission within the legislative branch of
19 government.
20 (2)(a) The commission shall consist of not more than
21 25 members, including:
22 1. Eight persons who are former members of the House
23 of Representatives, to be appointed by the Speaker of the
24 House of Representatives.
25 2. Eight persons who are former members of the Senate,
26 to be appointed by the President of the Senate.
27 3. The Clerk of the House of Representatives, the
28 Secretary of the Senate, and the Sergeant at Arms of each
29 house.
30 4. The President of Tallahassee Community College, or
31 his or her designee.

1 5. The Secretary of State, or his or her designee.
2 6. The director of the commission.
3 7. Up to two other persons selected by the commission.
4 (b) The persons appointed under subparagraphs (a)1.
5 and 2. shall be appointed to serve staggered terms of 4 years.
6 Of the initial appointees, two persons appointed by the
7 Speaker of the House of Representatives and two persons
8 appointed by the President of the Senate shall be appointed to
9 serve terms of 4 years, two persons appointed by the Speaker
10 and two persons appointed by the President shall be appointed
11 to serve terms of 3 years, two persons appointed by the
12 Speaker and two persons appointed by the President shall be
13 appointed to serve terms of 2 years, and the remaining
14 appointees shall be appointed to serve terms of 1 year, as
15 determined by the appointing presiding officer. In making the
16 initial appointments, each presiding officer must reappoint
17 any current or former member of the house over which the
18 presiding officer presides; however, if more than six such
19 persons are presently serving on the commission, the presiding
20 officer need reappoint only six of such persons. The terms of
21 the initial appointees shall begin July 1, 2004.
22 (3) The commission shall elect from among its members
23 a chair and vice chair and such other officers as it desires.
24 The commission shall adopt its own rules of procedure, except
25 that with respect to the provisions of s. 24, Art. I of the
26 State Constitution, the commission shall abide by the rules of
27 both houses regarding the enforcement of the section. The
28 rules of procedure must provide that the meetings of the
29 commission will be open and that the public will be given
30 notice of the meetings.

1 (4) The commission shall employ a director who must be
2 appointed by the commission with the advice and consent of the
3 President of the Senate and the Speaker of the House of
4 Representatives and shall serve at the pleasure of those
5 legislative officers.
6 (5) Members of the commission shall receive no
7 compensation for their service on the commission but may be
8 reimbursed for per diem and travel expenses pursuant to s.
9 112.061.
10 (6) The commission shall meet at the call of the chair
11 at least twice annually.
12 (7) The duties of the commission shall include:
13 (a) Serving the Legislature with respect to the
14 collection and preservation of the historic records of both
15 houses of the Legislature. The commission shall provide a plan
16 for the collection of historical information that is written,
17 oral, anecdotal, or in the nature of artifacts.
18 (b) Providing for the availability of the historical
19 information identified by the commission by the most
20 appropriate means available, including by electronic
21 transmission. The commission may also use any means available
22 to entities created under chapters 257 and 267.
23 (c) Overseeing and maintaining the operation of the
24 Legislative Research Center and Museum located on the campus
25 of Tallahassee Community College in Tallahassee.
26 (d) Overseeing, collecting, and expending funds
27 allocated by the Legislature and any other funds received from
28 other sources.
29 (e) Performing such other duties as the commission
30 considers necessary to the historic preservation of the
31 records of the Legislature.

1 (8) In addition to other powers granted under this
2 section, the commission may:
3 (a) Make and enter into such contracts and agreements
4 as it determines are necessary, expedient, or incidental to
5 the performance of its duties.
6 (b) Accept gifts, grants, bequests, loans, and
7 endowments for purposes not inconsistent with its
8 responsibilities under this section.
9 (9) This section does not eliminate the duties of the
10 Department of State under s. 15.07.
11 Section 2. This act shall take effect July 1, 2004.
