11 Senator Sebesta moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 70, between lines 22 and 23,
15
16 insert:
17 Section 57. For the purpose of incorporating the
18 amendment to section 322.61, Florida Statutes, in a reference
19 thereto, subsection (14) of section 322.64, Florida Statutes,
20 is reenacted to read:
21 322.64 Holder of commercial driver's license; driving
22 with unlawful blood-alcohol level; refusal to submit to
23 breath, urine, or blood test.--
24 (14) The decision of the department under this section
25 shall not be considered in any trial for a violation of s.
26 316.193, s. 322.61, or s. 322.62, nor shall any written
27 statement submitted by a person in his or her request for
28 departmental review under this section be admissible into
29 evidence against him or her in any such trial. The disposition
30 of any related criminal proceedings shall not affect a
31 disqualification imposed pursuant to this section.
