1 A bill to be entitled
2 An act relating to driving privilege; providing
3 a popular name; creating s. 318.1225, F.S.;
4 providing additional charges for certain
5 traffic violations; providing for distribution
6 of moneys collected; amending s. 318.21, F.S.;
7 revising provisions relating to disposition of
8 civil penalties by county courts; creating s.
9 322.287, F.S.; providing additional fees for
10 reinstatement of suspended driving privilege;
11 providing for distribution of moneys collected;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. This act shall be known by the popular name
17 the "Dori Slosberg Road Safety Act."
18 Section 2. Section 318.1225, Florida Statutes, is
19 created to read:
20 318.1225 Additional charges for violation.--
21 (1) Notwithstanding s. 318.121 and in addition to the
22 stated fines in s. 318.18, the court shall impose an
23 additional $50 fine for all moving violations and an
24 additional $20 fine for all nonmoving violations.
25 (2) Notwithstanding s. 318.121 and in addition to any
26 other fines imposed, the court shall impose an additional $500
27 fine for any person who violates s. 316.027(1).
28 (3) Notwithstanding s. 318.121 and in addition to any
29 other fines imposed, the court shall impose a $500 surcharge
30 on any fine imposed pursuant to s. 316.192, s. 316.193, or s.
31 316.1935.

1 (4) All additional fines and surcharges collected
2 pursuant to this section and s. 322.287 shall be distributed
3 by the department as follows:
4 (a) One million dollars shall be distributed annually
5 to MADD Florida for public service announcements in the state.
6 (b) Ten million dollars shall be distributed annually
7 to the Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer's
8 Research.
9 (c) Five hundred thousand dollars shall be distributed
10 annually to the Brain and Spinal Cord Injury Program Trust
11 Fund for the purposes set forth in s. 381.79.
12 (d) Five hundred thousand dollars shall be distributed
13 annually to the University of Florida Neuroscience Laboratory.

15 Of the remaining funds resulting from the additional fines and
16 surcharges, 50 percent shall be used to fund new teachers'
17 salaries to meet constitutional school class size requirements
18 and 50 percent shall be used to fund additional highway patrol
19 officers for the enforcement of state traffic laws.
20 Section 3. Subsection (13) is added to section 318.21,
21 Florida Statutes, to read:
22 318.21 Disposition of civil penalties by county
23 courts.--All civil penalties received by a county court
24 pursuant to the provisions of this chapter shall be
25 distributed and paid monthly as follows:
26 (13) The additional fines and surcharges provided for
27 under s. 318.1225 must be collected by the clerk of the court
28 and remitted to the department for distribution as provided in
29 that section.
30 Section 4. Section 322.287, Florida Statutes, is
31 created to read:

1 322.287 Reinstatement fees.--
2 (1) In addition to any other fines, fees, or charges
3 imposed, the department shall impose an additional $50 fee for
4 reinstating and returning a license suspended pursuant to s.
5 322.27.
6 (2) In addition to any other fines, fees, or charges
7 imposed, the department shall impose an additional $500 fee
8 for reinstating and returning a license suspended pursuant to
9 s. 322.2615 or s. 322.2616.
10 (3) No driving privileges shall be reinstated until
11 complete payment of the applicable fees under this section.
12 (4) All moneys collected pursuant to this section
13 shall be distributed in the manner provided in s. 318.1225.
14 Section 5. This act shall take effect October 1, 2004.
