  2         An act relating to the Florida Institute for

  3         Nuclear Detection and Security; creating s.

  4         1004.63, F.S.; creating the Florida Institute

  5         for Nuclear Detection and Security at the

  6         Department of Nuclear Engineering and

  7         Radiological Sciences at the University of

  8         Florida; specifying the purpose of the

  9         institute; authorizing the institute to accept

10         funds and grant allocations; providing for the

11         appointment of a board of advisors; providing

12         an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Section 1004.63, Florida Statutes, is

17  created to read:

18         1004.63  Florida Institute for Nuclear Detection and

19  Security (FINDS).--

20         (1)  There is created the Florida Institute for Nuclear

21  Detection and Security at the University of Florida to serve

22  as a design-basis center for research, development, testing,

23  and engineering projects that directly address and satisfy

24  critical nuclear detection and security needs facing the state

25  and the nation. The institute shall be established within the

26  Department of Nuclear Engineering and Radiological Sciences at

27  the university and shall consist of faculty, support staff,

28  and other staff funded by state, federal, and private funds

29  collected for the purposes of the institute. The institute

30  shall be headed by a director who shall be appointed by the

31  Dean of the University of Florida College of Engineering,

 1  serving at the pleasure of the Dean, and who shall possess a

 2  national reputation in the field of nuclear sciences.

 3         (2)  The institute shall solicit and receive state,

 4  federal, and private funds for the purpose of conducting

 5  research and development in the area of nuclear security

 6  technology. The board shall ensure that the institute

 7  maintains accurate records of any funds received by the

 8  institute.

 9         (3)  Activities of the institute shall include, but not

10  be limited to, the design and testing of innovative

11  interrogation, detection, and assessment devices for

12  monitoring nuclear material. Application areas shall include,

13  but not be limited to: portal monitoring, wide area search and

14  cargo screening applications; structural monitoring for

15  post-tensioned bridges; biological and agricultural

16  monitoring; and the development of nonproliferation policies.

17         (4)  The institute shall explore development of devices

18  for identification of isotopes and materials in structural,

19  agricultural, and biological systems of various types.

20         (5)  Through research and instructional programs, the

21  faculty associated with the institute shall also contribute to

22  the education and training of high-quality scientists and

23  engineers in the application of engineering solutions in

24  homeland security, detection, imaging, and interrogation of

25  systems, and nonproliferation policy.

26         (6)(a)  The activities of the institute shall be

27  directed by the Florida Institute of Nuclear Detection and

28  Security (FINDS) Board of Advisors, who shall serve without

29  compensation and shall consist of eight members. Members of

30  the board of advisors shall include, but are not limited to, a

31  citizen of the State of Florida with interest in the area of

 1  public security; a faculty member from FINDS; a scientist of

 2  national reputation in the field of nuclear sciences; a

 3  representative of the nuclear energy industry in Florida; a

 4  representative of the national nuclear energy industry; a

 5  representative of the Federal government programs in nuclear

 6  energy or homeland security; a member of the Florida Senate

 7  Committee on Home Defense, Public Security, and Ports; and a

 8  member of the Florida House Coordinating Committee on Public

 9  Security.

10         (b)  Appointments for the initial terms shall be as

11  follows:

12         1.  Two members shall be appointed by the chair of the

13  University of Florida Department of Nuclear Engineering and

14  Radiological Sciences and shall be appointed to a term of 3

15  years;

16         2.  Two members shall be appointed by the Dean of the

17  University of Florida College of Engineering and shall be

18  appointed to a term of 2 years;

19         3.  Two members shall be appointed by the President of

20  the University of Florida and shall be appointed to a term of

21  3 years; and

22         4.  Two members shall be appointed by the Governor and

23  shall be appointed to a term of 4 years.

24         (c)  Members may serve one additional 4-year term.

25         (d)  Board members shall serve without additional

26  compensation or honorarium and are authorized to receive only

27  per diem and reimbursement for travel expenses as provided in

28  s. 112.061.

29         (e)  The board may employ a director of the institute

30  who serves at the pleasure of the board. The director of FINDS

31  will be an ex officio member of the board of advisors.

 1         (7)  At the FINDS Board of Advisors first meeting, the

 2  chair of the Department of Nuclear Engineering at the

 3  University of Florida will act as chair for the purpose of

 4  convening the meeting, establishing the by-laws of the board,

 5  and electing the chair of the board.

 6         (8)  FINDS, through its board of advisors, shall submit

 7  an annual report on its progress, with recommendations on

 8  nuclear security and detection, to the Governor, the President

 9  of the Senate, and the Speaker of the House of

10  Representatives. The report must also include financial

11  statements that include an accounting of all state, federal,

12  and private funds that are received by the institute, as well

13  as an accounting of the expenditures of the institute. A copy

14  of the financial statement shall also be provided to the

15  Auditor General.

16         Section 2.  This act shall take effect July 1, 2004.

21  Provides that the institute is headed by a director appointed
    by the Dean of the University of College of Engineering.

    Establishes an eight member board to direct the institute.
23  Provides the process by which board members are appointed.

24  Provides that board members receive per diem and travel
    expenses as provided in s. 112.061, F.S.
25  
    Requires the institute to include a financial accounting of
26  funds received and expenditures made in its annual report.
    Requires a copy of financial statement to be filed with the
27  Auditor General.
