14 Delete everything after the enacting clause

16 and insert:
17 Section 1. Section 1006.0625, Florida Statutes, is
18 created to read:
19 1006.0625 Prohibition on requiring certain
20 medication.--
21 (1) Each district school board shall prohibit school
22 district personnel from requiring a student to obtain a
23 prescription for, and take as medication, a controlled
24 substance listed in Schedule II, s. 202(c) of the Controlled
25 Substances Act, 21 U.S.C. s. 812(c), or any psychotropic or
26 similar mind-altering drug as a condition of attending school
27 or receiving educational services provided by the state.
28 Nothing in this section shall be construed to prohibit school
29 district personnel from consulting or sharing classroom-based
30 observations with parents regarding a student's academic
31 performance or behavior in the classroom or school or

1 regarding the need for evaluation for special education or
2 related services provided the evaluation is strictly academic
3 and not psychologically or psychiatrically based.
4 (2) The State Board of Education shall adopt rules
5 pursuant to ss. 120.536(1) and 120.54 to implement the
6 provisions of this section.
7 Section 2. This act shall take effect July 1, 2004.
