1 A bill to be entitled
2 An act relating to education; providing that a
3 school district may not require a student to
4 obtain a prescription for any specified
5 controlled substance as a prerequisite to the
6 student's attending school or receiving other
7 services of the school district; providing for
8 rulemaking by the Department of Education;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Obtaining a prescription for a controlled
14 substance may not be required of a student.--
15 (1) A school district may not require that a student
16 who attends school in the district must, as a prerequisite to
17 the student's attending school or receiving any other services
18 of the school district, obtain a prescription for a controlled
19 substance listed in schedule II under s. 202(c) of the federal
20 Controlled Substances Act, 21 U.S.C. s. 812(c), as amended by
21 Title 21 C.F.R. part 1308.
22 (2) The Department of Education shall develop rules
23 containing policies and procedures that prohibit school
24 personnel from requiring a student to obtain a prescription
25 for a controlled substance in violation of subsection (1).
26 Section 2. This act shall take effect July 1, 2004.

3 Provides that a school district may not require a student
