1 House Joint Resolution
2          A joint resolution proposing an amendment to Section 23 of
3    Article I of the State Constitution to limit the
4    application to minors of the constitutional right to
5    privacy and any other provision of the State Constitution
6    to the extent such application would limit the rights or
7    authority of parents or legal guardians provided by law or
8    would limit the authority of the government to advance or
9    secure such rights or authority of parents or legal
10    guardians.

12          Be It Resolved by the Legislature of the State of Florida:
13         
14          That the amendment to Section 23 of Article I of the State
15    Constitution set forth below is agreed to and shall be submitted
16    to the electors of Florida for approval or rejection at the
17    general election to be held in November 2004:
18 ARTICLE I
19 DECLARATION OF RIGHTS
20          SECTION 23. Right of privacy.--Every natural person has
21    the right to be let alone and free from governmental intrusion
22    into the person's private life except as otherwise provided
23    herein. This section shall not be construed to limit the
24    public's right of access to public records and meetings as
25    provided by law. Neither this section nor any other provision of
26    the Constitution of Florida shall be construed with respect to
27    minors so as to limit the rights or authority of parents or
28    legal guardians as otherwise provided by law or to limit the
29    authority of the government to advance or secure such rights or
30    authority of parents or legal guardians.
31          BE IT FURTHER RESOLVED that the title and substance of the
32    amendment proposed herein shall appear on the ballot as follows:

34          Proposes an amendment to Section 23 of Article I of the
35    State Constitution to limit the application to minors of the
36    constitutional right to privacy and any other provision of the
37    State Constitution to the extent such application would limit
38    the rights or authority of parents or legal guardians provided
39    by law or would limit the authority of the government to advance
40    or secure such rights or authority of parents or legal
41    guardians.
