1 A bill to be entitled
2 An act relating to unemployment compensation
3 for spouses of members of the military;
4 amending s. 443.101, F.S.; providing
5 eligibility for unemployment compensation
6 benefits for the spouses of a member of the
7 military under certain circumstances; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (a) of subsection (1) of section
13 443.101, Florida Statutes, is amended to read:
14 443.101 Disqualification for benefits.--An individual
15 shall be disqualified for benefits:
16 (1)(a) For the week in which he or she has voluntarily
17 left his or her work without good cause attributable to his or
18 her employing unit or in which the individual has been
19 discharged by his or her employing unit for misconduct
20 connected with his or her work, based on a finding by the
21 Agency for Workforce Innovation. As used in this paragraph,
22 the term "work" means any work, whether full-time, part-time,
23 or temporary.
24 1. Disqualification for voluntarily quitting continues
25 for the full period of unemployment next ensuing after he or
26 she has left his or her full-time, part-time, or temporary
27 work voluntarily without good cause and until the individual
28 has earned income equal to or in excess of 17 times his or her
29 weekly benefit amount. As used in this subsection, the term
30 "good cause" includes only that cause attributable to the
31 employing unit or which consists of illness or disability of

1 the individual requiring separation from his or her work. Any
2 other disqualification may not be imposed. An individual is
3 not disqualified under this subsection for voluntarily leaving
4 work to relocate as a result of his or her military-connected
5 spouse's permanent change of station orders, activation
6 orders, or unit deployment orders. An individual is not
7 disqualified under this subsection for voluntarily leaving
8 temporary work to return immediately when called to work by
9 the permanent employing unit that temporarily terminated his
10 or her work within the previous 6 calendar months.
11 2. Disqualification for being discharged for
12 misconduct connected with his or her work continues for the
13 full period of unemployment next ensuing after having been
14 discharged and until the individual has become reemployed and
15 has earned income of at least 17 times his or her weekly
16 benefit amount and for not more than 52 weeks that immediately
17 follow that week, as determined by the Agency for Workforce
18 Innovation in each case according to the circumstances in each
19 case or the seriousness of the misconduct, under the agency's
20 rules adopted for determinations of disqualification for
21 benefits for misconduct.
22 Section 2. This act shall take effect upon becoming a
23 law.

27 Provides that a person is not disqualified for
unemployment compensation benefits who voluntarily leaves
28 employment due to relocation as a result of his or her
spouse's military orders.
