| 7 | Foundation, Inc., under specified circumstances; providing | 
| 8 | an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: | 
| 11 | 
 | 
| 12 | Section 1.  Subsections D and E of section 4 of section 3 | 
| 13 | of chapter 2002-348, Laws of Florida, are amended to read: | 
| 14 | Section 4.  POWERS, FUNCTIONS, AND DUTIES.-- | 
| 15 | D.  Tax proceeds to charitable foundations; hospitals.--All | 
| 16 | future tax proceeds generated from within the Northeast | 
| 17 | Territory, less one-half of the amount reserved annually by the | 
| 18 | board to pay for maintenance and services for the board, shall | 
| 19 | be paid by the board of trustees to Florida Hospital Waterman | 
| 20 | Foundation, Inc., or other entity determined by Florida Hospital | 
| 21 | Waterman Foundation, Inc., if they so desire in order to | 
| 22 | maximize moneys received, upon written request by Florida | 
| 23 | Hospital Waterman Foundation, Inc., that the funds are needed | 
| 24 | for health care. All future proceeds generated from within the | 
| 25 | Northwest Territory, less one-half of the amount reserved | 
| 26 | annually by the board to pay for maintenance and services for | 
| 27 | the board, shall be paid by the board of trustees to Leesburg | 
| 28 | Regional Medical Center Charitable Foundation, Inc., or other | 
| 29 | entity determined by Leesburg Regional Medical Center Charitable | 
| 30 | Foundation, Inc., if they so desire in order to maximize moneys | 
| 31 | received, upon written request by Leesburg Regional Medical | 
| 32 | Center Charitable Foundation, Inc., that the funds are needed | 
| 33 | for health care. | 
| 34 | E.  LifeStream Behavioral Center.--Leesburg Regional | 
| 35 | Medical Center Charitable Foundation Foundations, Inc., and | 
| 36 | Florida Hospital Waterman Foundation, Inc., have brought to the | 
| 37 | attention of their therespective boards that LifeStream | 
| 38 | Behavioral Center should be entitled to receive the following | 
| 39 | sums, after submission of a written request by LifeStream | 
| 40 | Behavioral Center certifying that the funds are needed for | 
| 41 | indigent health care. The request shall be made to Florida | 
| 42 | Hospital Waterman Foundation, Inc., and Leesburg Regional | 
| 43 | Medical Center Charitable Foundation, Inc. Florida Hospital | 
| 44 | Waterman Foundation, Inc., and Leesburg Regional Medical Center | 
| 45 | Charitable Foundation, Inc., shall pay the following sums to | 
| 46 | LifeStream Behavioral Center from their respective share of tax | 
| 47 | funds collected and received by Florida Hospital Waterman | 
| 48 | Foundation, Inc., and Leesburg Regional Medical Center | 
| 49 | Charitable Foundation, Inc. | 
| 50 | 1.  For each year after calendar year 1993, LifeStream | 
| 51 | Behavioral Center shall be paid $100,000 or  1/20  of 1 mill of | 
| 52 | the tax moneys due Florida Hospital Waterman Foundation, Inc., | 
| 53 | from the Northeast Territory, whichever is greater, plus | 
| 54 | $100,000 or  1/20  of 1 mill of the tax moneys due Leesburg | 
| 55 | Regional Medical Center Charitable Foundation, Inc., from the | 
| 56 | Northwest Territory, whichever is greater. If Florida Hospital | 
| 57 | Waterman Foundation, Inc., or Leesburg Regional Medical Center | 
| 58 | Charitable Foundation, Inc., refuses to pay LifeStream | 
| 59 | Behavioral Center the funds due under this section in any given | 
| 60 | year, during the next fiscal year of the Board of Trustees of | 
| 61 | the North Lake County Hospital District, the Board of Trustees | 
| 62 | of the North Lake County Hospital District shall directly pay | 
| 63 | LifeStream Behavioral Center an amount equal to the funds | 
| 64 | withheld during the previous year by the subject provider | 
| 65 | payable from funds that whichwould otherwise be payable to the | 
| 66 | subject provider. | 
| 67 | 2.  Notwithstanding any of the provisions of this act, the | 
| 68 | obligation to pay tax revenues to LifeStream Behavioral Center | 
| 69 | under this act shall permanently terminate in the year: | 
| 70 | a.  When a countywide health taxing district is created and | 
| 71 | funded pursuant to chapter 154, Florida Statutes, the countywide | 
| 72 | health taxing district provides for reimbursement on an | 
| 73 | accountability basis to medical providers for medical, hospital, | 
| 74 | and emergency care, including psychiatric care provided to | 
| 75 | indigents indigentresiding within the county, and the | 
| 76 | countywide health taxing district actually reimburses LifeStream | 
| 77 | Behavioral Center for medical services in an amount greater than | 
| 78 | or equal to the tax revenues received under the provisions of | 
| 79 | this act in 1 calendar year; or | 
| 80 | b.  If LifeStream Behavioral Center, for any reason, loses, | 
| 81 | relinquishes, or forfeits its accreditation as a hospital. | 
| 82 | 
 | 
| 83 | Any reimbursement for medical services paid to LifeStream | 
| 84 | Behavioral Center by any future countywide health taxing | 
| 85 | district shall be deducted from the amount of tax revenues to be | 
| 86 | paid under this act. It is the intent of this act that the tax | 
| 87 | revenue revenuespayments provided for LifeStream Behavioral | 
| 88 | Center in this act be reduced by the same amount that is | 
| 89 | actually paid to the hospital by the countywide taxing district. | 
| 90 | Section 2.  This act shall take effect upon becoming a law. |
