A bill to be entitled
2An act relating to the North Lake County Hospital
3District, Lake County; amending chapter 2002-348, Laws of
4Florida; providing for payment of tax proceeds to
5designees of the Florida Hospital Waterman Foundation,
6Inc., and Leesburg Regional Medical Center Charitable
7Foundation, Inc., under specified circumstances; providing
8an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsections D and E of section 4 of section 3
13of chapter 2002-348, Laws of Florida, are amended to read:
14     Section 4.  POWERS, FUNCTIONS, AND DUTIES.--
15     D.  Tax proceeds to charitable foundations; hospitals.--All
16future tax proceeds generated from within the Northeast
17Territory, less one-half of the amount reserved annually by the
18board to pay for maintenance and services for the board, shall
19be paid by the board of trustees to Florida Hospital Waterman
20Foundation, Inc., or other entity determined by Florida Hospital
21Waterman Foundation, Inc., if they so desire in order to
22maximize moneys received, upon written request by Florida
23Hospital Waterman Foundation, Inc., that the funds are needed
24for health care. All future proceeds generated from within the
25Northwest Territory, less one-half of the amount reserved
26annually by the board to pay for maintenance and services for
27the board, shall be paid by the board of trustees to Leesburg
28Regional Medical Center Charitable Foundation, Inc., or other
29entity determined by Leesburg Regional Medical Center Charitable
30Foundation, Inc., if they so desire in order to maximize moneys
31received, upon written request by Leesburg Regional Medical
32Center Charitable Foundation, Inc., that the funds are needed
33for health care.
34     E.  LifeStream Behavioral Center.--Leesburg Regional
35Medical Center Charitable Foundation Foundations, Inc., and
36Florida Hospital Waterman Foundation, Inc., have brought to the
37attention of their the respective boards that LifeStream
38Behavioral Center should be entitled to receive the following
39sums, after submission of a written request by LifeStream
40Behavioral Center certifying that the funds are needed for
41indigent health care. The request shall be made to Florida
42Hospital Waterman Foundation, Inc., and Leesburg Regional
43Medical Center Charitable Foundation, Inc. Florida Hospital
44Waterman Foundation, Inc., and Leesburg Regional Medical Center
45Charitable Foundation, Inc., shall pay the following sums to
46LifeStream Behavioral Center from their respective share of tax
47funds collected and received by Florida Hospital Waterman
48Foundation, Inc., and Leesburg Regional Medical Center
49Charitable Foundation, Inc.
50     1.  For each year after calendar year 1993, LifeStream
51Behavioral Center shall be paid $100,000 or  1/20  of 1 mill of
52the tax moneys due Florida Hospital Waterman Foundation, Inc.,
53from the Northeast Territory, whichever is greater, plus
54$100,000 or  1/20  of 1 mill of the tax moneys due Leesburg
55Regional Medical Center Charitable Foundation, Inc., from the
56Northwest Territory, whichever is greater. If Florida Hospital
57Waterman Foundation, Inc., or Leesburg Regional Medical Center
58Charitable Foundation, Inc., refuses to pay LifeStream
59Behavioral Center the funds due under this section in any given
60year, during the next fiscal year of the Board of Trustees of
61the North Lake County Hospital District, the Board of Trustees
62of the North Lake County Hospital District shall directly pay
63LifeStream Behavioral Center an amount equal to the funds
64withheld during the previous year by the subject provider
65payable from funds that which would otherwise be payable to the
66subject provider.
67     2.  Notwithstanding any of the provisions of this act, the
68obligation to pay tax revenues to LifeStream Behavioral Center
69under this act shall permanently terminate in the year:
70     a.  When a countywide health taxing district is created and
71funded pursuant to chapter 154, Florida Statutes, the countywide
72health taxing district provides for reimbursement on an
73accountability basis to medical providers for medical, hospital,
74and emergency care, including psychiatric care provided to
75indigents indigent residing within the county, and the
76countywide health taxing district actually reimburses LifeStream
77Behavioral Center for medical services in an amount greater than
78or equal to the tax revenues received under the provisions of
79this act in 1 calendar year; or
80     b.  If LifeStream Behavioral Center, for any reason, loses,
81relinquishes, or forfeits its accreditation as a hospital.

83Any reimbursement for medical services paid to LifeStream
84Behavioral Center by any future countywide health taxing
85district shall be deducted from the amount of tax revenues to be
86paid under this act. It is the intent of this act that the tax
87revenue revenues payments provided for LifeStream Behavioral
88Center in this act be reduced by the same amount that is
89actually paid to the hospital by the countywide taxing district.
90     Section 2.  This act shall take effect upon becoming a law.
