7An act relating to the North Lake County Hospital
8District, Lake County; amending chapter 2002-348, Laws of
9Florida; providing for payment of tax proceeds to
10designees of the Florida Hospital Waterman, Inc., and
11Leesburg Regional Medical Center, Inc., under specified
12circumstances; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida
15
16     Section 1.  Subsections D and E of section 4 of section 3
17of chapter 2002-348, Laws of Florida, are amended to read:
18     Section 4.  POWERS, FUNCTIONS, AND DUTIES.--
19     D.  Tax proceeds to charitable foundations; hospitals.--All
20future tax proceeds generated from within the Northeast
21Territory, less one-half of the amount reserved annually by the
22board to pay for maintenance and services for the board, shall
23be paid by the board of trustees to Florida Hospital Waterman
24Foundation, Inc., or other entity determined by Florida Hospital
25Waterman, Inc., if it so desires in order to maximize moneys
26received, upon written request by Florida Hospital Waterman
27Foundation, Inc., that the funds are needed for health care. All
28future proceeds generated from within the Northwest Territory,
29less one-half of the amount reserved annually by the board to
30pay for maintenance and services for the board, shall be paid by
31the board of trustees to Leesburg Regional Medical Center
32Charitable Foundation, Inc., or other entity determined by
33Leesburg Regional Medical Center, Inc., if it so desires in
34order to maximize moneys received, upon written request by
35Leesburg Regional Medical Center Charitable Foundation, Inc.,
36that the funds are needed for health care.
37     E.  LifeStream Behavioral Center.--Leesburg Regional
38Medical Center Charitable Foundations, Inc., and Florida
39Hospital Waterman Foundation, Inc., have brought to the
40attention of their the respective boards that LifeStream
41Behavioral Center should be entitled to receive the following
42sums, after submission of a written request by LifeStream
43Behavioral Center certifying that the funds are needed for
44indigent health care. The request shall be made to Florida
45Hospital Waterman Foundation, Inc., and Leesburg Regional
46Medical Center Charitable Foundation, Inc. Florida Hospital
47Waterman Foundation, Inc., and Leesburg Regional Medical Center
48Charitable Foundation, Inc., shall pay the following sums to
49LifeStream Behavioral Center from their respective share of tax
50funds collected and received by Florida Hospital Waterman
51Foundation, Inc., and Leesburg Regional Medical Center
52Charitable Foundation, Inc.
53     1.  For each year after calendar year 1993, LifeStream
54Behavioral Center shall be paid $100,000 or 1/20 of 1 mill of
55the tax moneys due Florida Hospital Waterman Foundation, Inc.,
56from the Northeast Territory, whichever is greater, plus
57$100,000 or 1/20 of 1 mill of the tax moneys due Leesburg
58Regional Medical Center Charitable Foundation, Inc., from the
59Northwest Territory, whichever is greater. If Florida Hospital
60Waterman Foundation, Inc., or Leesburg Regional Medical Center
61Charitable Foundation, Inc., refuses to pay LifeStream
62Behavioral Center the funds due under this section in any given
63year, during the next fiscal year of the Board of Trustees of
64the North Lake County Hospital District, the Board of Trustees
65of the North Lake County Hospital District shall directly pay
66LifeStream Behavioral Center an amount equal to the funds
67withheld during the previous year by the subject provider
68payable from funds that which would otherwise be payable to the
69subject provider.
70     2.  Notwithstanding any of the provisions of this act, the
71obligation to pay tax revenues to LifeStream Behavioral Center
72under this act shall permanently terminate in the year:
73     a.  When a countywide health taxing district is created and
74funded pursuant to chapter 154, Florida Statutes, the countywide
75health taxing district provides for reimbursement on an
76accountability basis to medical providers for medical, hospital,
77and emergency care, including psychiatric care provided to
78indigents indigent residing within the county, and the
79countywide health taxing district actually reimburses LifeStream
80Behavioral Center for medical services in an amount greater than
81or equal to the tax revenues received under the provisions of
82this act in 1 calendar year; or
83     b.  If LifeStream Behavioral Center, for any reason, loses,
84relinquishes, or forfeits its accreditation as a hospital.

86Any reimbursement for medical services paid to LifeStream
87Behavioral Center by any future countywide health taxing
88district shall be deducted from the amount of tax revenues to be
89paid under this act. It is the intent of this act that the tax
90revenue revenues payments provided for LifeStream Behavioral
91Center in this act be reduced by the same amount that is
92actually paid to the hospital by the countywide taxing district.
93     Section 2.  This act shall take effect upon becoming a law.
