11 | Section 1. Subsections D and E of section 4 of section 3 |
12 | of chapter 2002-348, Laws of Florida, are amended to read: |
13 | Section 4. POWERS, FUNCTIONS, AND DUTIES.-- |
14 | D. Tax proceeds to charitable foundations; hospitals.--All |
15 | future tax proceeds generated from within the Northeast |
16 | Territory, less one-half of the amount reserved annually by the |
17 | board to pay for maintenance and services for the board, shall |
18 | be paid by the board of trustees to Florida Hospital Waterman |
19 | Foundation, Inc., or other entity determined by Florida Hospital |
20 | Waterman, Inc., if it so desires in order to maximize moneys |
21 | received, upon written request by Florida Hospital Waterman |
22 | Foundation, Inc., that the funds are needed for health care. All |
23 | future proceeds generated from within the Northwest Territory, |
24 | less one-half of the amount reserved annually by the board to |
25 | pay for maintenance and services for the board, shall be paid by |
26 | the board of trustees to Leesburg Regional Medical Center |
27 | Charitable Foundation, Inc., or other entity determined by |
28 | Leesburg Regional Medical Center, Inc., if it so desires in |
29 | order to maximize moneys received, upon written request by |
30 | Leesburg Regional Medical Center Charitable Foundation, Inc., |
31 | that the funds are needed for health care. |
32 | E. LifeStream Behavioral Center.--Leesburg Regional |
33 | Medical Center Charitable Foundations, Inc., and Florida |
34 | Hospital Waterman Foundation, Inc., have brought to the |
35 | attention of their the respective boards that LifeStream |
36 | Behavioral Center should be entitled to receive the following |
37 | sums, after submission of a written request by LifeStream |
38 | Behavioral Center certifying that the funds are needed for |
39 | indigent health care. The request shall be made to Florida |
40 | Hospital Waterman Foundation, Inc., and Leesburg Regional |
41 | Medical Center Charitable Foundation, Inc. Florida Hospital |
42 | Waterman Foundation, Inc., and Leesburg Regional Medical Center |
43 | Charitable Foundation, Inc., shall pay the following sums to |
44 | LifeStream Behavioral Center from their respective share of tax |
45 | funds collected and received by Florida Hospital Waterman |
46 | Foundation, Inc., and Leesburg Regional Medical Center |
47 | Charitable Foundation, Inc. |
48 | 1. For each year after calendar year 1993, LifeStream |
49 | Behavioral Center shall be paid $100,000 or 1/20 of 1 mill of |
50 | the tax moneys due Florida Hospital Waterman Foundation, Inc., |
51 | from the Northeast Territory, whichever is greater, plus |
52 | $100,000 or 1/20 of 1 mill of the tax moneys due Leesburg |
53 | Regional Medical Center Charitable Foundation, Inc., from the |
54 | Northwest Territory, whichever is greater. If Florida Hospital |
55 | Waterman Foundation, Inc., or Leesburg Regional Medical Center |
56 | Charitable Foundation, Inc., refuses to pay LifeStream |
57 | Behavioral Center the funds due under this section in any given |
58 | year, during the next fiscal year of the Board of Trustees of |
59 | the North Lake County Hospital District, the Board of Trustees |
60 | of the North Lake County Hospital District shall directly pay |
61 | LifeStream Behavioral Center an amount equal to the funds |
62 | withheld during the previous year by the subject provider |
63 | payable from funds that which would otherwise be payable to the |
64 | subject provider. |
65 | 2. Notwithstanding any of the provisions of this act, the |
66 | obligation to pay tax revenues to LifeStream Behavioral Center |
67 | under this act shall permanently terminate in the year: |
68 | a. When a countywide health taxing district is created and |
69 | funded pursuant to chapter 154, Florida Statutes, the countywide |
70 | health taxing district provides for reimbursement on an |
71 | accountability basis to medical providers for medical, hospital, |
72 | and emergency care, including psychiatric care provided to |
73 | indigents indigent residing within the county, and the |
74 | countywide health taxing district actually reimburses LifeStream |
75 | Behavioral Center for medical services in an amount greater than |
76 | or equal to the tax revenues received under the provisions of |
77 | this act in 1 calendar year; or |
78 | b. If LifeStream Behavioral Center, for any reason, loses, |
79 | relinquishes, or forfeits its accreditation as a hospital. |

81 | Any reimbursement for medical services paid to LifeStream |
82 | Behavioral Center by any future countywide health taxing |
83 | district shall be deducted from the amount of tax revenues to be |
84 | paid under this act. It is the intent of this act that the tax |
85 | revenue revenues payments provided for LifeStream Behavioral |
86 | Center in this act be reduced by the same amount that is |
87 | actually paid to the hospital by the countywide taxing district. |
88 | Section 2. This act shall take effect upon becoming a law. |
