2An act relating to the North Lake County Hospital
3District, Lake County; amending chapter 2002-348, Laws of
4Florida; providing for payment of tax proceeds to
5designees of the Florida Hospital Waterman, Inc., and
6Leesburg Regional Medical Center, Inc., under specified
7circumstances; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida
10
11     Section 1.  Subsections D and E of section 4 of section 3
12of chapter 2002-348, Laws of Florida, are amended to read:
13     Section 4.  POWERS, FUNCTIONS, AND DUTIES.--
14     D.  Tax proceeds to charitable foundations; hospitals.--All
15future tax proceeds generated from within the Northeast
16Territory, less one-half of the amount reserved annually by the
17board to pay for maintenance and services for the board, shall
18be paid by the board of trustees to Florida Hospital Waterman
19Foundation, Inc., or other entity determined by Florida Hospital
20Waterman, Inc., if it so desires in order to maximize moneys
21received, upon written request by Florida Hospital Waterman
22Foundation, Inc., that the funds are needed for health care. All
23future proceeds generated from within the Northwest Territory,
24less one-half of the amount reserved annually by the board to
25pay for maintenance and services for the board, shall be paid by
26the board of trustees to Leesburg Regional Medical Center
27Charitable Foundation, Inc., or other entity determined by
28Leesburg Regional Medical Center, Inc., if it so desires in
29order to maximize moneys received, upon written request by
30Leesburg Regional Medical Center Charitable Foundation, Inc.,
31that the funds are needed for health care.
32     E.  LifeStream Behavioral Center.--Leesburg Regional
33Medical Center Charitable Foundations, Inc., and Florida
34Hospital Waterman Foundation, Inc., have brought to the
35attention of their the respective boards that LifeStream
36Behavioral Center should be entitled to receive the following
37sums, after submission of a written request by LifeStream
38Behavioral Center certifying that the funds are needed for
39indigent health care. The request shall be made to Florida
40Hospital Waterman Foundation, Inc., and Leesburg Regional
41Medical Center Charitable Foundation, Inc. Florida Hospital
42Waterman Foundation, Inc., and Leesburg Regional Medical Center
43Charitable Foundation, Inc., shall pay the following sums to
44LifeStream Behavioral Center from their respective share of tax
45funds collected and received by Florida Hospital Waterman
46Foundation, Inc., and Leesburg Regional Medical Center
47Charitable Foundation, Inc.
48     1.  For each year after calendar year 1993, LifeStream
49Behavioral Center shall be paid $100,000 or 1/20 of 1 mill of
50the tax moneys due Florida Hospital Waterman Foundation, Inc.,
51from the Northeast Territory, whichever is greater, plus
52$100,000 or 1/20 of 1 mill of the tax moneys due Leesburg
53Regional Medical Center Charitable Foundation, Inc., from the
54Northwest Territory, whichever is greater. If Florida Hospital
55Waterman Foundation, Inc., or Leesburg Regional Medical Center
56Charitable Foundation, Inc., refuses to pay LifeStream
57Behavioral Center the funds due under this section in any given
58year, during the next fiscal year of the Board of Trustees of
59the North Lake County Hospital District, the Board of Trustees
60of the North Lake County Hospital District shall directly pay
61LifeStream Behavioral Center an amount equal to the funds
62withheld during the previous year by the subject provider
63payable from funds that which would otherwise be payable to the
64subject provider.
65     2.  Notwithstanding any of the provisions of this act, the
66obligation to pay tax revenues to LifeStream Behavioral Center
67under this act shall permanently terminate in the year:
68     a.  When a countywide health taxing district is created and
69funded pursuant to chapter 154, Florida Statutes, the countywide
70health taxing district provides for reimbursement on an
71accountability basis to medical providers for medical, hospital,
72and emergency care, including psychiatric care provided to
73indigents indigent residing within the county, and the
74countywide health taxing district actually reimburses LifeStream
75Behavioral Center for medical services in an amount greater than
76or equal to the tax revenues received under the provisions of
77this act in 1 calendar year; or
78     b.  If LifeStream Behavioral Center, for any reason, loses,
79relinquishes, or forfeits its accreditation as a hospital.

81Any reimbursement for medical services paid to LifeStream
82Behavioral Center by any future countywide health taxing
83district shall be deducted from the amount of tax revenues to be
84paid under this act. It is the intent of this act that the tax
85revenue revenues payments provided for LifeStream Behavioral
86Center in this act be reduced by the same amount that is
87actually paid to the hospital by the countywide taxing district.
88     Section 2.  This act shall take effect upon becoming a law.
