1 A bill to be entitled
2          An act relating to the Department of Highway Safety and
3    Motor Vehicles; amending s. 322.27, F.S.; requiring law
4    enforcement agencies to notify the department of any
5    traffic fatality or when a law enforcement agency
6    initiates action to obtain a blood test for purposes of
7    determining alcoholic content or presence of chemical or
8    controlled substances in a case of death or serious bodily
9    injury; amending s. 322.20, F.S.; requiring the department
10    to maintain records of convictions of persons holding a
11    foreign license to drive; providing an effective date.

13          Be It Enacted by the Legislature of the State of Florida:
14         
15          Section 1. Paragraph (a) of subsection (1) of section
16    322.27, Florida Statutes, is amended to read:
17          322.27 Authority of department to suspend or revoke
18    license.--
19          (1) Notwithstanding any provisions to the contrary in
20    chapter 120, the department is hereby authorized to suspend the
21    license of any person without preliminary hearing upon a showing
22    of its records or other sufficient evidence that the licensee:
23          (a) Has committed an offense for which mandatory
24    revocation of license is required upon conviction. A law
25    enforcement agency must provide information to the department
26    within 24 hours after any traffic fatality or when the law
27    enforcement agency initiates action pursuant to s. 316.1933;
28          Section 2. Subsection (2) of section 322.20, Florida
29    Statutes, is amended to read:
30          322.20 Records of the department; fees; destruction of
31    records.--
32          (2) The department shall also maintain a record of all
33    crash reports, abstracts of court records of convictions, and
34    notices of revocation or suspension of a person's driver's
35    license or driving privilege. Records of convictions of a person
36    holding a foreign license to drive shall be maintained by the
37    department if the uniform traffic citation indicates an address
38    located in this state.
39          Section 3. This act shall take effect July 1, 2004.
