1 A bill to be entitled
2 An act relating to prevention and control of
3 communicable diseases; amending s. 381.003,
4 F.S.; requiring the Department of Health to
5 adopt certain standards applicable to all
6 public sector employers; providing an exception
7 for certain public sector employers to certain
8 blood-borne-pathogen standards adopted by the
9 Department of Health; requiring the compilation
10 and maintenance of certain information by the
11 department for use by employers; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (3) is added to section 381.003,
17 Florida Statutes, to read:
18 381.003 Communicable disease and AIDS prevention and
19 control.--
20 (3) The department shall by rule adopt the
21 blood-borne-pathogen standard set forth in subpart Z of 29
22 C.F.R. part 1910, as amended by Pub. L. No. 106-430, which
23 shall apply to all public sector employers, except public
24 sector employers whose compliance with the standard is
25 required and regulated by federal law. The department shall
26 compile and maintain a list of existing needleless systems and
27 sharps with engineered sharps-injury protection which shall be
28 available to assist employers, including the department and
29 the Department of Corrections, in complying with the
30 applicable requirements of the blood-borne-pathogen standard.

1 information, including, without limitation, the United States
2 Food and Drug Administration, the Centers for Disease Control
3 and Prevention, the Occupational Safety and Health
4 Administration, and the United States Department of Veterans
5 Affairs.
6 Section 2. This act shall take effect July 1. 2004.

8 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

11 The committee substitute provides an exception to the
blood-borne pathogen standard adopted by the Department of
12 Health for certain public sector employers whose compliance
with the blood-borne pathogen standards is required and
13 regulated by federal law.
