1 A bill to be entitled
2 An act relating to liability insurance;
3 creating s. 1006.245, F.S.; requiring school
4 districts to pay only from insurance proceeds
5 any damages awarded against the district
6 through a claims bill; providing minimum
7 amounts of coverage for insurance against such
8 damages; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 1006.245, Florida Statutes, is
13 created to read:
14 1006.245 School district required to pay claims from
15 insurance proceeds; required insurance coverage.--
16 (1) If the Legislature requires a school district to
17 pay a claimant damages under a claims bill brought on behalf
18 of the claimant pursuant to s. 768.28, the school district
19 must pay the entire amount of the damages out of proceeds from
20 insurance and may not use moneys derived from any other source
21 to make such payment.
22 (2) In addition to other insurance requirements,
23 including, but not limited to, those set forth in s. 1006.24,
24 each district school board shall secure and keep in force
25 insurance for paying damages awarded under claims bills in the
26 amount of at least $500,000 or 1 percent of the operating
27 budget of the school district, whichever is less.
28 Section 2. This act shall take effect July 1, 2004.
