9 | Be It Enacted by the Legislature of the State of Florida: |

11 | Section 1. Subsection (6) of section 561.57, Florida |
12 | Statutes, is amended to read: |
13 | 561.57 Deliveries by licensees.-- |
14 | (6) Common carriers are not required to have vehicle |
15 | permits to transport alcoholic beverages. Nothing in this |
16 | section shall prohibit any common carrier, or any licensee or |
17 | other person utilizing a common carrier as his or her agent, |
18 | from making a delivery from any place within the state to any |
19 | other place within the state. Intrastate deliveries of alcoholic |
20 | beverages by common carriers, or licensees or other persons |
21 | utilizing common carriers as their agents, are exempt from the |
22 | report filing requirements in s. 562.20. All common carriers |
23 | acting as designated agents for delivery shall verify that any |
24 | person receiving alcoholic beverages is at least 21 years of age |
25 | upon the delivery of such alcoholic beverages, as prescribed in |
26 | the division's rules. The prescribed age verification shall give |
27 | the common carrier and the licensee or other person hiring the |
28 | common carrier a complete defense of selling, giving, or serving |
29 | alcoholic beverages to any person under the age of 21. |
30 | Section 2. This act shall take effect upon becoming a law. |
