2An act relating to alcoholic beverage deliveries; amending
3s. 561.57, F.S.; exempting common carriers making certain
4deliveries from certain report filing requirements;
5requiring common carriers to verify the age of certain
6recipients; providing for defense under certain
7circumstances; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (6) of section 561.57, Florida
12Statutes, is amended to read:
13     561.57  Deliveries by licensees.--
14     (6)  Common carriers are not required to have vehicle
15permits to transport alcoholic beverages. Nothing in this
16section shall prohibit any common carrier, or any licensee or
17other person utilizing a common carrier as his or her agent,
18from making a delivery from any place within the state to any
19other place within the state. Intrastate deliveries of alcoholic
20beverages by common carriers, or licensees or other persons
21utilizing common carriers as their agents, are exempt from the
22report filing requirements in s. 562.20. All common carriers
23acting as designated agents for delivery shall verify that any
24person receiving alcoholic beverages is at least 21 years of age
25upon the delivery of such alcoholic beverages, as prescribed in
26the division's rules. The prescribed age verification shall give
27the common carrier and the licensee or other person hiring the
28common carrier a complete defense of selling, giving, or serving
29alcoholic beverages to any person under the age of 21.
30     Section 2.  This act shall take effect upon becoming a law.
