1 A bill to be entitled
2 An act relating to the practice of orthotics,
3 prosthetics, and pedorthics; creating s.
4 468.8051, F.S.; providing that individuals who
5 previously applied for licensure to the
6 Department of Health prior to a certain date
7 and who have been approved by the Board of
8 Orthotists and Prosthetists to practice
9 orthotics, prosthetics, or pedorthics may be
10 licensed as a prosthetist, orthotist, orthotic
11 fitter assistant, or pedorthist without meeting
12 certain educational requirements; requiring the
13 Board of Orthotists and Prosthetists to
14 investigate the individual's background and
15 experience; providing an application fee;
16 specifying periods of experience required for
17 licensure; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Section 468.8051, Florida Statutes, is
22 created amended to read:
23 468.8051 Grandfathering.--A person who has practiced
24 orthotics, prosthetics, or pedorthics in this state for the
25 required period since July 1, 1990, and who applied before
26 March 1, 1998, and has been approved by the department for a
27 license to practice orthotics, prosthetics, or pedorthics, may
28 be licensed as a prosthetist, orthotist, orthotic fitter
29 assistant, or pedorthist, as determined from the person's
30 experience and educational preparation without meeting the
31 educational requirements set forth in s. 468.803, upon receipt

1 of the application fee and licensing fee and after the board
2 has completed an investigation into the applicant's background
3 and experience. The board shall require an application fee not
4 to exceed $500, which shall be nonrefundable. The board shall
5 complete its investigation within 6 months after receipt of he
6 completed application. The period of experience required for
7 licensure under this section is 10 years for a prosthetist; 2
8 years for a orthotic fitter, an orthotic fitter assistant, or
9 a pedorthist; and 10 years for an orthotist whose scope of
10 practice is defined under s. 468.80(7). Any person who meets
11 this requirement shall be licensed by the department.
12 Section 2. This act shall take effect upon becoming a
13 law.

16 SENATE SUMMARY
17 Requires the Department of Health to issue certain
additional licenses if the applicant applied for
18 licensure to the department prior to July 1, 1998, and
was approved by the Board of Orthotists and Prosthetists
19 to practice orthotics, prosthetics, or pedorthics,
notwithstanding certain educational requirements.
