6An act relating to prevention and control of communicable
7diseases; amending s. 381.003, F.S.; requiring the
8Department of Health to adopt certain standards applicable
9to public sector employers; providing an exception;
10requiring the compilation and maintenance of certain
11information by the department for use by employers;
12providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Subsection (3) is added to section 381.003,
17Florida Statutes, to read:
18     381.003  Communicable disease and AIDS prevention and
19control.--
20     (3)  The department shall by rule adopt the blood-borne-
21pathogen standard set forth in subpart Z of 29 C.F.R. part 1910,
22as amended by Pub. L. No. 106-430, which shall apply to all
23public sector employers, except public sector employers whose
24compliance with the standard is required and regulated by
25federal law. The department shall compile and maintain a list of
26existing needleless systems and sharps with engineered sharps-
27injury protection which shall be available to assist employers,
28including the department and the Department of Corrections, in
29complying with the applicable requirements of the blood-borne-
30pathogen standard. The list may be developed from existing
31sources of information, including, without limitation, the
32United States Food and Drug Administration, the Centers for
33Disease Control and Prevention, the Occupational Safety and
34Health Administration, and the United States Department of
35Veterans Affairs.
36     Section 2.  This act shall take effect July 1, 2004.
