9 | to public sector employers; providing an exception; |
10 | requiring the compilation and maintenance of certain |
11 | information by the department for use by employers; |
12 | providing an effective date. |

14 | Be It Enacted by the Legislature of the State of Florida: |

16 | Section 1. Subsection (3) is added to section 381.003, |
17 | Florida Statutes, to read: |
18 | 381.003 Communicable disease and AIDS prevention and |
19 | control.-- |
20 | (3) The department shall by rule adopt the blood-borne- |
21 | pathogen standard set forth in subpart Z of 29 C.F.R. part 1910, |
22 | as amended by Pub. L. No. 106-430, which shall apply to all |
23 | public sector employers, except public sector employers whose |
24 | compliance with the standard is required and regulated by |
25 | federal law. The department shall compile and maintain a list of |
26 | existing needleless systems and sharps with engineered sharps- |
27 | injury protection which shall be available to assist employers, |
28 | including the department and the Department of Corrections, in |
29 | complying with the applicable requirements of the blood-borne- |
30 | pathogen standard. The list may be developed from existing |
31 | sources of information, including, without limitation, the |
32 | United States Food and Drug Administration, the Centers for |
33 | Disease Control and Prevention, the Occupational Safety and |
34 | Health Administration, and the United States Department of |
35 | Veterans Affairs. |
36 | Section 2. This act shall take effect July 1, 2004. |
