  1                      A bill to be entitled

  2         An act relating to specialty behavioral health

  3         care providers; requiring the Department of

  4         Children and Family Services to establish a

  5         demonstration project in District 4 in order to

  6         determine the benefits of developing a

  7         specialty behavioral health care provider to

  8         deliver behavioral health services to persons

  9         who reside in an assisted living facility that

10         holds a limited mental health license;

11         requiring the department to select the provider

12         through a competitive bid process; directing

13         the department to create a workgroup to develop

14         the request for proposal; providing for

15         membership on the workgroup; providing for the

16         department to assist the Agency for Health Care

17         Administration in selecting the managed care

18         entity delivering behavioral health care;

19         requiring the department to implement the

20         demonstration project by a specific date;

21         providing for an independent evaluation;

22         requiring that a report be submitted to the

23         Legislature; providing an effective date.

25  Be It Enacted by the Legislature of the State of Florida:

26  

27         Section 1.  (1)  The Department of Children and Family

28  Services shall establish a demonstration project in District 4

29  for the purpose of determining the benefits of a specialty

30  behavioral health care provider delivering behavioral health

 1  services to persons who reside in an assisted living facility

 2  that holds a limited mental health license.

 3         (2)  The department shall use a competitive bid process

 4  to select the private or publicly funded behavioral health

 5  care provider that will deliver the services listed in section

 6  394.4574, Florida Statutes, and all other state-funded

 7  behavioral health care services, including services listed in

 8  section 394.4574, Florida Statutes.

 9         (3)(a)  The department must create a workgroup to

10  develop the request for proposal and recommend the standards,

11  criteria, and array of services that will be included in the

12  procurement document.

13         (b)  The workgroup must be composed of not less than 12

14  members. The membership shall include, but need not be limited

15  to:

16         1.  Five administrators of assisted living facilities

17  holding a limited mental health license. The five

18  administrators must be selected by members of the National

19  Alliance of the Mentally Ill (NAMI) who represent District 4;

20         2.  One person who is a member of the Florida

21  Psychiatric Society, selected by the society;

22         3.  One person who is a member of the Florida Council

23  for Behavioral Health, selected by the council;

24         4.  One person who is a member of the National Alliance

25  for the Mentally Ill, selected by the alliance;

26         5.  One person who is a member of the Florida Hospital

27  Association, selected by the association;

28         6.  One person who is a member of the Florida Assisted

29  Living Association, selected by the association;

30         7.  One person who is a member of the local advocacy

31  council, selected by the local council; and

 1         8.  A representative from the Advocacy Center for

 2  Persons with Disabilities, selected by the advocacy center.

 3         (4)  If the Agency for Health Care Administration

 4  implements a Medicaid managed care system in District 4, the

 5  agency shall authorize the selected behavioral health care

 6  provider for the demonstration project to negotiate a

 7  capitation rate for the behavioral health care services which

 8  reflects the needs and clinical services required to ensure

 9  that residents of assisted living facilities that hold a

10  limited mental health license are not displaced or otherwise

11  denied access to medically necessary behavioral health care

12  services as determined by the provider and consistent with the

13  resident's right of access to adequate and appropriate health

14  care under section 400.022, Florida Statutes.

15         (5)  The District 4 demonstration project must be

16  implemented by October 1, 2004, and shall continue for not

17  less than 3 years following the date of implementation.

18         (6)  The department shall contract for an independent

19  evaluation of the demonstration project. The evaluation must

20  assess the recidivism of patients from the assisted living

21  facility to the inpatient state hospital, patient satisfaction

22  with care, improvements in program competencies and linkages,

23  increased tenure of case management relationships with

24  residents, and implementation of meaningful plans of recovery.

25  Following the evaluation, the department shall prepare a

26  report and submit a copy to the President of the Senate and

27  the Speaker of the House of Representatives by January 1,

28  2007.

29         Section 2.  This act shall take effect July 1, 2004.
