A bill to be entitled
2An act relating to protective injunctions; amending s.
3784.047, F.S.; increasing the penalty for a violation of a
4protective injunction against repeat violence, sexual
5violence, dating violence, or domestic violence; providing
6that it is a third degree felony to commit a crime against
7the property of a petitioner or a protected person in
8violation of a protective injunction; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 784.047, Florida Statutes, is amended
14to read:
15     784.047  Penalties for violating protective injunction
16against violators.--A person who willfully violates an
17injunction for protection against domestic violence issued
18pursuant to s. 741.30; an injunction for protection against
19repeat violence, sexual violence, or dating violence, issued
20pursuant to s. 784.046;, or a foreign protection order accorded
21full faith and credit pursuant to s. 741.315 by:
22     (1)  Refusing to vacate the dwelling that the parties
23share;
24     (2)  Going to the petitioner's residence, school, place of
25employment, or a specified place frequented regularly by the
26petitioner and any named family or household member;
27     (3)  Committing an act of repeat violence or dating
28violence against the petitioner;
29     (4)  Committing any other violation of the injunction
30through an intentional unlawful threat, word, or act to do
31violence to the petitioner; or
32     (5)  Telephoning, contacting, or otherwise communicating
33with the petitioner directly or indirectly, unless the
34injunction specifically allows indirect contact through a third
35party,;

37commits a felony misdemeanor of the second first degree,
38punishable as provided in s. 775.082, or s. 775.083, or s.
39775.084.
40     (6)  Committing a crime against the property of the
41petitioner or other protected person commits a felony of the
42third degree, punishable as provided in s. 775.082, s. 775.083,
43or s. 775.084.
44     Section 2.  This act shall take effect July 1, 2004.
