3     Amendment (with directory and title amendments)
4     Remove lines 106-110 and insert:

6     Section 3.  Paragraph (c) of subsection (1) of section
7464.009, Florida Statutes, is amended, subsections (3), (4), and
8(5) of said section are redesignated as subsections (4), (5),
9and (6), respectively, and a new subsection (3) is added to said
10section, to read:
11     464.009  Licensure by endorsement.--
12     (1)  The department shall issue the appropriate license by
13endorsement to practice professional or practical nursing to an
14applicant who, upon applying to the department and remitting a
15fee set by the board not to exceed $100, demonstrates to the
16board that he or she:
17     (c)  Has actively practiced nursing in another state,
18jurisdiction, or territory of the United States for 2 of the
19preceding 3 years without having his or her license acted
20against by the licensing authority of any jurisdiction.
21Applicants who become licensed pursuant to this paragraph must
22complete within 6 months after licensure a Florida laws and
23rules course that is approved by the board. Once the department
24has received the results of the national criminal history check
25and has determined that the applicant has no criminal history,
26the appropriate license by endorsement shall be issued to the
27applicant. This paragraph is repealed July 1, 2004, unless
28reenacted by the Legislature.
