1 A bill to be entitled
2 An act relating to multiservice senior centers;
3 amending s. 430.203, F.S.; amending a
4 definition; amending s. 403.206, F.S.;
5 encouraging each multiservice senior center to
6 have a functioning automated external
7 defibrillator; requiring training, maintenance,
8 and location registration; providing immunity
9 from liability under the Good Samaritan Act and
10 the Cardiac Arrest Survival Act; authorizing
11 the Department of Eldery Affairs to adopt
12 rules; requiring the department to arrange for
13 purchase of such defibrillators; requiring
14 certain entities to reimburse the department
15 for purchased defibrillators under certain
16 circumstances; providing criteria for
17 distribution of such defibrillators; providing
18 an appropriation; providing effective dates.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (10) of section 430.203, Florida
23 Statutes, is amended to read:
24 430.203 Community care for the elderly;
25 definitions.--As used in ss. 430.201-430.207, the term:
26 (10) "Multiservice senior center" means a community
27 facility for the organization and provision of a broad
28 spectrum of that serves as the focal point for housing and
29 delivering services, which shall include provision of health,
30 including mental health, social, nutritional, and education
31 services, and the provision of facilities for recreational

1 activities for to persons 60 years of age or older. A
2 multiservice senior center may also be a facility as
3 designated by the department in its master plan prepared
4 pursuant to s. 430.04(3).
5 Section 2. Subsection (3) is added to section 430.206,
6 Florida Statutes, to read:
7 430.206 Multiservice senior center.--
8 (3)(a) Effective July 1, 2005, each multiservice
9 senior center is encouraged to have on the premises at all
10 times a functioning automated external defibrillator.
11 (b) Multiservice senior centers that provide automated
12 external defibrillators shall ensure that personnel are
13 properly trained in accordance with s. 401.2915.
14 (c) The location of each automated defibrillator shall
15 be registered with the appropriate county office by the
16 multiservice senior center pursuant to s. 401.2915.
17 (d) The use of automated external defibrillators by
18 employees and volunteers shall be covered under the provisions
19 of ss. 768.13 and 768.1325.
20 (e) The department may adopt rules to implement the
21 provisions of this section.
22 Section 3. There is hereby appropriated to the
23 Department of Elderly Affairs a sum of $270,000 to implement
24 the provisions of this act. The department shall arrange for
25 the purchase of as many automated external defibrillators as
26 may be purchased with available funds. Senior centers shall
27 reimburse the department for 50 percent of the cost of the
28 automated external defibrillator provided to their facility.
29 Multiservice senior centers located in rural communities, as
30 defined in sections 288.0656(2)(b) and 288.06561, Florida
31 Statutes, shall not be required to reimburse the department

1 for the costs of such equipment. The department shall
2 authorize issuance of the equipment to senior centers in the
3 order in which they request one and shall provide
4 authorization for only one to each multiservice center
5 pursuant to this section.
6 Section 4. Except as otherwise provided herein, this
7 act shall take effect upon becoming a law.
