2 An act relating to multiservice senior centers;
3 amending s. 430.203, F.S.; amending a
4 definition; amending s. 403.206, F.S.;
5 encouraging each multiservice senior center to
6 have a functioning automated external
7 defibrillator; requiring training, maintenance,
8 and location registration; providing immunity
9 from liability under the Good Samaritan Act and
10 the Cardiac Arrest Survival Act; authorizing
11 the Department of Elderly Affairs to adopt
12 rules; requiring the department to arrange for
13 purchase of such defibrillators; requiring
14 certain entities to reimburse the department
15 for purchased defibrillators under certain
16 circumstances; providing criteria for
17 distribution of such defibrillators; providing
18 an appropriation; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (10) of section 430.203, Florida
23 Statutes, is amended to read:
24 430.203 Community care for the elderly;
25 definitions.--As used in ss. 430.201-430.207, the term:
26 (10) "Multiservice senior center" means a community
27 facility for the organization and provision of a broad
28 spectrum of that serves as the focal point for housing and
29 delivering services, which shall include provision of health,
30 including mental health, social, nutritional, and education

1 services, and the provision of facilities for recreational
2 activities for to persons 60 years of age or older.
3 Section 2. Subsection (3) is added to section 430.206,
4 Florida Statutes, to read:
5 430.206 Multiservice senior center.--
6 (3)(a) Each multiservice senior center is encouraged
7 to have on the premises at all times a functioning automated
8 external defibrillator.
9 (b) Multiservice senior centers that provide automated
10 external defibrillators shall ensure that personnel are
11 properly trained in accordance with s. 401.2915.
12 (c) The location of each automated external
13 defibrillator shall be registered with a local emergency
14 medical services medical director.
15 (d) The use of automated external defibrillators by
16 employees and volunteers shall be covered under the provisions
17 of ss. 768.13 and 768.1325.
18 (e) The department may adopt rules to implement the
19 provisions of this section.
20 Section 3. The sum of $270,000 is appropriated from
21 the General Revenue Fund to the Department of Elderly Affairs
22 for the purpose of implementing this act during the 2004-2005
23 fiscal year. The department shall arrange for the purchase of
24 as many automated external defibrillators as may be purchased
25 with available funds. Senior centers shall reimburse the
26 department for 50 percent of the cost of the automated
27 external defibrillator provided to their facility.
28 Multiservice senior centers located in rural communities, as
29 defined in section 288.0656(2)(b), Florida Statutes, shall not
30 be required to reimburse the department for the costs of such
31 equipment. The department shall authorize issuance of the

1 equipment to senior centers in the order in which they request
2 one and shall provide authorization for only one to each
3 multiservice center pursuant to this section.
4 Section 4. This act shall take effect upon becoming a
5 law.
