3institutions; providing a popular name; amending s.
41000.06, F.S.; requiring the flag of the United States to
5be displayed in each classroom in public K-20 educational
6institutions; providing for procurement of flags;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  This act shall be known by the popular name the
12"Carey Baker Freedom Flag Act."
13     Section 2.  Section 1000.06, Florida Statutes, is amended
14to read:
15     1000.06  Display of flags.--
16     (1)  Every public K-20 educational institution that is
17provided or authorized by the Constitution and laws of Florida
18shall display daily the flag of the United States and the
19official flag of Florida when the weather permits upon one
20building or on a suitable flagstaff upon the grounds of each
21public postsecondary educational institution and upon every
22district school board building or grounds except when the
23institution or school is closed for vacation, provided that, if
24two or more buildings are located on the same or on adjacent
25sites, one flag may be displayed for the entire group of
26buildings.
27     (2)  Each public K-20 educational institution that is
28provided or authorized by the Constitution and laws of Florida
29shall display daily in each classroom the flag of the United
30States. The flag must be made in the United States, must be at
31least 2 feet by 3 feet, and must be properly displayed in
32accordance with Title 4 U.S.C. Each educational institution
33shall acquire the necessary number of flags to implement the
34provisions of this subsection. The principal, director, or
35president of each educational institution shall attempt to
36acquire the flags through donations or fundraising for 1 year
37prior to securing other funding sources or allocating funds for
38the purchase of flags. The president of each state university or
39community college must present to the governing board of the
40institution the results of donations and fundraising activities
41relating to the acquisition of flags prior to requesting the
42governing board to approve a funding source for the purchase of
43flags. A flag must be displayed in each classroom pursuant to
44this subsection no later than August 1, 2005.
45     Section 3.  This act shall take effect July 1, 2004.
