9 | Be It Enacted by the Legislature of the State of Florida: |
10 |

11 | Section 1. This act shall be known by the popular name the |
12 | "Carey Baker Freedom Flag Act." |
13 | Section 2. Section 1000.06, Florida Statutes, is amended |
14 | to read: |
15 | 1000.06 Display of flags.-- |
16 | (1) Every public K-20 educational institution that is |
17 | provided or authorized by the Constitution and laws of Florida |
18 | shall display daily the flag of the United States and the |
19 | official flag of Florida when the weather permits upon one |
20 | building or on a suitable flagstaff upon the grounds of each |
21 | public postsecondary educational institution and upon every |
22 | district school board building or grounds except when the |
23 | institution or school is closed for vacation, provided that, if |
24 | two or more buildings are located on the same or on adjacent |
25 | sites, one flag may be displayed for the entire group of |
26 | buildings. |
27 | (2) Each public K-20 educational institution that is |
28 | provided or authorized by the Constitution and laws of Florida |
29 | shall display daily in each classroom the flag of the United |
30 | States. The flag must be made in the United States, must be at |
31 | least 2 feet by 3 feet, and must be properly displayed in |
32 | accordance with Title 4 U.S.C. Each educational institution |
33 | shall acquire the necessary number of flags to implement the |
34 | provisions of this subsection. The principal, director, or |
35 | president of each educational institution shall attempt to |
36 | acquire the flags through donations or fundraising for 1 year |
37 | prior to securing other funding sources or allocating funds for |
38 | the purchase of flags. The president of each state university or |
39 | community college must present to the governing board of the |
40 | institution the results of donations and fundraising activities |
41 | relating to the acquisition of flags prior to requesting the |
42 | governing board to approve a funding source for the purchase of |
43 | flags. A flag must be displayed in each classroom pursuant to |
44 | this subsection no later than August 1, 2005. |
45 | Section 3. This act shall take effect July 1, 2004. |
