1 A bill to be entitled
2          An act relating to cargo theft; reenacting s. 812.014(1)
3    and (2), F.S., relating to theft; amending s. 921.0022,
4    F.S.; reclassifying the offenses of cargo theft of the
5    first degree and cargo theft of the second degree under
6    the offense severity ranking chart of the Criminal
7    Punishment Code to increase the penalties imposed for any
8    such offense; providing an effective date.
9         
10          Be It Enacted by the Legislature of the State of Florida:
11         
12          Section 1. Subsections (1) and (2) of section 812.014,
13    Florida Statutes, are reenacted to read:
14          812.014 Theft.--
15          (1) A person commits theft if he or she knowingly obtains
16    or uses, or endeavors to obtain or to use, the property of
17    another with intent to, either temporarily or permanently:
18          (a) Deprive the other person of a right to the property or
19    a benefit from the property.
20          (b) Appropriate the property to his or her own use or to
21    the use of any person not entitled to the use of the property.
22          (2)(a)1. If the property stolen is valued at $100,000 or
23    more; or
24          2. If the property stolen is cargo valued at $50,000 or
25    more that has entered the stream of interstate or intrastate
26    commerce from the shipper's loading platform to the consignee's
27    receiving dock; or
28          3. If the offender commits any grand theft and:
29          a. In the course of committing the offense the offender
30    uses a motor vehicle as an instrumentality, other than merely as
31    a getaway vehicle, to assist in committing the offense and
32    thereby damages the real property of another; or
33          b. In the course of committing the offense the offender
34    causes damage to the real or personal property of another in
35    excess of $1,000,
36         
37          the offender commits grand theft in the first degree, punishable
38    as a felony of the first degree, as provided in s. 775.082, s.
39    775.083, or s. 775.084.
40          (b)1. If the property stolen is valued at $20,000 or more,
41    but less than $100,000;
42          2. The property stolen is cargo valued at less than
43    $50,000 that has entered the stream of interstate or intrastate
44    commerce from the shipper's loading platform to the consignee's
45    receiving dock; or
46          3. The property stolen is emergency medical equipment,
47    valued at $300 or more, that is taken from a facility licensed
48    under chapter 395 or from an aircraft or vehicle permitted under
49    chapter 401,
50         
51          the offender commits grand theft in the second degree,
52    punishable as a felony of the second degree, as provided in s.
53    775.082, s. 775.083, or s. 775.084. Emergency medical equipment
54    means mechanical or electronic apparatus used to provide
55    emergency services and care as defined in s. 395.002(10) or to
56    treat medical emergencies.
57          (c) It is grand theft of the third degree and a felony of
58    the third degree, punishable as provided in s. 775.082, s.
59    775.083, or s. 775.084, if the property stolen is:
60          1. Valued at $300 or more, but less than $5,000.
61          2. Valued at $5,000 or more, but less than $10,000.
62          3. Valued at $10,000 or more, but less than $20,000.
63          4. A will, codicil, or other testamentary instrument.
64          5. A firearm.
65          6. A motor vehicle, except as provided in paragraph
66    (2)(a).
67          7. Any commercially farmed animal, including any animal of
68    the equine, bovine, or swine class, or other grazing animal, and
69    including aquaculture species raised at a certified aquaculture
70    facility. If the property stolen is aquaculture species raised
71    at a certified aquaculture facility, then a $10,000 fine shall
72    be imposed.
73          8. Any fire extinguisher.
74          9. Any amount of citrus fruit consisting of 2,000 or more
75    individual pieces of fruit.
76          10. Taken from a designated construction site identified
77    by the posting of a sign as provided for in s. 810.09(2)(d).
78          11. Any stop sign.
79          12. Anyhydrous ammonia.
80          (d) It is grand theft of the third degree and a felony of
81    the third degree, punishable as provided in s. 775.082, s.
82    775.083, or s. 775.084, if the property stolen is valued at $100
83    or more, but less than $300, and is taken from a dwelling as
84    defined in s. 810.011(2) or from the unenclosed curtilage of a
85    dwelling pursuant to s. 810.09(1).
86          (e) Except as provided in paragraph (d), if the property
87    stolen is valued at $100 or more, but less than $300, the
88    offender commits petit theft of the first degree, punishable as
89    a misdemeanor of the first degree, as provided in s. 775.082 or
90    s. 775.083.
91          Section 2. Paragraphs (f), (g), and (h) of subsection (3)
92    of section 921.0022, Florida Statutes, are amended to read:
