1 A bill to be entitled
2 An act relating to persons appointed or
3 employed to work with children; requiring that
4 each state or governmental subdivision search
5 the records of sexual predators and sexual
6 offenders maintained by the Department of Law
7 Enforcement before appointing or employing a
8 person to work or volunteer at a park,
9 playground, day care center, or other place
10 where children regularly congregate;
11 authorizing use of the department's toll-free
12 telephone number or Internet site to conduct
13 the search; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Search of registration information
18 regarding sexual predators and sexual offenders required prior
19 to appointment or employment.--A state agency or governmental
20 subdivision, prior to making any decision to appoint or employ
21 a person to work, whether for compensation or as a volunteer,
22 at any park, playground, day care center, or other place where
23 children regularly congregate, must conduct a search of that
24 person's name or other identifying information against the
25 registration information regarding sexual predators and sexual
26 offenders maintained by the Department of Law Enforcement
27 under section 943.043, Florida Statutes. The agency or
28 governmental subdivision may conduct the search using the
29 toll-free telephone number or the Internet site maintained by
30 the Department of Law Enforcement.

1 Section 2. This act shall take effect upon becoming a
2 law.

5 SENATE SUMMARY
6 Prohibits a state or governmental subdivision from
appointing or employing a person to work or volunteer at
7 a park, playground, day care center, or other place where
children regularly congregate unless the agency or
8 subdivision has first searched the records of sexual
predators and sexual offenders maintained by the
9 Department of Law Enforcement.
