A bill to be entitled
2An act relating to a review under the Open Government
3Sunset Review Act; amending s. 365.174, F.S., relating to
4an exemption from public records requirements for
5proprietary confidential business information held by the
6Wireless 911 Board or the State Technology Office;
7removing the October 1, 2004, repeal thereof scheduled
8under the Open Government Sunset Review Act of 1995;
9clarifying the definition of "proprietary confidential
10business information"; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 365.174, Florida Statutes, is amended
15to read:
16     365.174  Proprietary confidential business information.--
17     (1)  All proprietary confidential business information
18submitted by a provider to the board or the office, including
19the name and billing or service addresses of service
20subscribers, and trade secrets as defined by s. 812.081, is
21confidential and exempt from s. 119.07(1) and s. 24(a), Art. I
22of the State Constitution. Statistical abstracts of information
23collected by the board or the office may be released or
24published, but only in a manner that does not identify or allow
25identification of subscribers or their service numbers or of
26revenues attributable to any provider.
27     (2)  As used in this section, the term "proprietary
28confidential business information" means customer lists,
29customer numbers, individual or aggregate customer data by
30location, usage and capacity data, network facilities used to
31serve subscribers and other related information, technology
32descriptions, technical information, or trade secrets, including
33trade secrets as defined in s. 812.081, and the actual or
34developmental costs of E911 systems that are developed,
35produced, or received internally by a provider or by a
36provider's employees, directors, officers, or agents.
37     (3)  This section is subject to the Open Government Sunset
38Review Act of 1995 in accordance with s. 119.15, and shall stand
39repealed on October 1, 2004, unless reviewed and saved from
40repeal through reenactment by the Legislature.
41     Section 2.  This act shall take effect October 1, 2004.
