| 4 | Between line(s) 29 and 30, insert: |
| 5 | Section 4. Effective January 1, 2006, subsection (13) of |
| 6 | section 101.5606, Florida Statutes, is amended, and subsection |
| 7 | (16) is added to said section, to read: |
| 8 | 101.5606 Requirements for approval of systems.--No |
| 9 | electronic or electromechanical voting system shall be approved |
| 10 | by the Department of State unless it is so constructed that: |
| 11 | (13) It is capable of producing a voter-verified paper |
| 12 | record providing records from which the operation of the voting |
| 13 | system may be audited that meets the following requirements:. |
| 14 | (a) The voting system shall produce a permanent paper |
| 15 | record, which shall be made available for inspection and |
| 16 | verification by the voter at the time the vote is cast and which |
| 17 | shall be maintained and preserved by the supervisor of elections |
| 18 | in the manner in which all other paper ballots are preserved by |
| 19 | the supervisor for later use in any manual audit or recount. |
| 20 | (b) The voting system shall provide the voter with an |
| 21 | opportunity to correct any error made by the system before the |
| 22 | permanent record is preserved for use in any manual audit or |
| 23 | recount. |
| 24 | (c) The voter-verified paper record shall be the official |
| 25 | record used for any recount conducted with respect to any |
| 26 | election in which the system is used. |
| 27 | (d) The voter-verified paper record shall not be produced |
| 28 | on thermal paper. |
| 29 | (16) It cannot at any time contain or use undisclosed |
| 30 | software or does not contain any wireless communication device. |
