3     Amendment to Amendment (934727) (with title amendment)
4Between line(s) 29 and 30, insert:
5     Section 4.  Effective January 1, 2006, subsection (13) of
6section 101.5606, Florida Statutes, is amended, and subsection
7(16) is added to said section, to read:
8     101.5606  Requirements for approval of systems.--No
9electronic or electromechanical voting system shall be approved
10by the Department of State unless it is so constructed that:
11     (13)  It is capable of producing a voter-verified paper
12record providing records from which the operation of the voting
13system may be audited that meets the following requirements:.
14     (a)  The voting system shall produce a permanent paper
15record, which shall be made available for inspection and
16verification by the voter at the time the vote is cast and which
17shall be maintained and preserved by the supervisor of elections
18in the manner in which all other paper ballots are preserved by
19the supervisor for later use in any manual audit or recount.
20     (b)  The voting system shall provide the voter with an
21opportunity to correct any error made by the system before the
22permanent record is preserved for use in any manual audit or
23recount.
24     (c)  The voter-verified paper record shall be the official
25record used for any recount conducted with respect to any
26election in which the system is used.
27     (d)  The voter-verified paper record shall not be produced
28on thermal paper.
29     (16)  It cannot at any time contain or use undisclosed
30software or does not contain any wireless communication device.
