1 A bill to be entitled
2 An act relating to motor vehicles; amending s.
3 316.251, F.S.; providing a definition and
4 revising maximum bumper-height requirements for
5 certain vehicles; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 316.251, Florida Statutes, is
10 amended to read:
11 316.251 Maximum bumper heights.--
12 (1) As used in this section, the term "bumper" means a
13 device or attachment on a vehicle for absorbing shock and
14 lessening or preventing damage to the vehicle body in a
15 collision or impact with another object, such as metal bars
16 attached to either end of the vehicle.
17 (2)(1) Every motor vehicle of net shipping weight of
18 not more than 10,000 5,000 pounds, which is registered for
19 private use under s. 320.08(2), shall be equipped with a front
20 and a rear bumper such that when measured from the ground to
21 the bottom of the bumper the maximum height shall be as
22 follows:

26 Automobiles for private use:
27 Net weight of less than 2,500 pounds 22" 22"
28 Net weight of 2,500 pounds or more,

7 (3)(2) "New motor vehicles" as defined in s.
8 319.001(8), "antique automobiles" as defined in s. 320.08,
9 "horseless carriages" as defined in s. 320.086, and "street
10 rods" as defined in s. 320.0863 shall be excluded from the
11 requirements of this section.
12 (4)(3) A violation of this section shall be defined as
13 a moving violation. A person charged with a violation of this
14 section is subject to the penalty provided in s. 318.18.
15 Section 2. This act shall take effect July 1, 2004.
