  2         An act relating to trauma regions; amending s.

  3         395.4015, F.S.; requiring that the boundaries

  4         of the trauma regions administered by the

  5         Department of Health be coterminous with the

  6         boundaries of the regional domestic security

  7         task forces established within the Department

  8         of Law Enforcement; authorizing the

  9         continuation of trauma services by certain

10         agencies in accordance with established

11         agreements and procedures; amending s. 395.402,

12         F.S.; providing requirements for the regional

13         trauma system plan when a trauma service area

14         is located within the boundaries of more than

15         one trauma region; providing an effective date.

17  Be It Enacted by the Legislature of the State of Florida:

18  

19         Section 1.  Section 395.4015, Florida Statutes, is

20  amended to read:

21         395.4015  State regional trauma planning; trauma

22  regions.--

23         (1)  The department shall establish a state trauma

24  system plan. As part of the state trauma system plan, the

25  department shall establish trauma regions that which cover all

26  geographical areas of the state and have boundaries that are

27  coterminous with the boundaries of the regional domestic

28  security task forces established under s. 943.0312. However,

29  the delivery of trauma services by or in coordination with a

30  trauma agency established before July 1, 2004, may continue in

31  accordance with any public or private agreements and

 1  operational procedures entered into as provided in s. 395.401.

 2  These regions may serve as the basis for the development of

 3  department-approved local or regional trauma plans. The

 4  department shall base its definition of the regions upon:

 5         (a)  Geographical considerations so as to ensure rapid

 6  access to trauma care by patients;

 7         (b)  Historical patterns of patient referral and

 8  transfer in an area;

 9         (c)  Inventories of available trauma care resources;

10         (d)  Predicted population growth characteristics;

11         (e)  Transportation capabilities, including ground and

12  air transport;

13         (f)  Medically appropriate ground and air travel times;

14  and

15         (g)  Other appropriate criteria.

16         (2)  The department shall develop trauma systems plans

17  for the department-defined trauma regions which include at a

18  minimum the following components:

19         (a)  An assessment of current and future trauma care

20  needs of the population, based upon incidence rates and acuity

21  indicators developed by the department, as well as other

22  relevant characteristics of the region.

23         (b)  The organizational structure of the regional

24  trauma system, including the identification of local trauma

25  agency service areas within the region.

26         (c)  Prehospital care management guidelines for triage

27  and transportation of trauma cases.

28         (d)  Flow patterns of trauma cases and transportation

29  system design and resources, including air transportation

30  services, provision for interfacility trauma transfer, and the

31  prehospital transportation of trauma victims. The department

 1  shall plan for the development of a system of transportation

 2  of trauma alert victims to trauma centers where the distance

 3  or time to a trauma center or transportation resources

 4  diminish access by trauma alert victims.

 5         (e)  The current and projected number, acuity level,

 6  and geographic location of trauma cases expected so as to

 7  assure that the assessed current and future trauma care needs

 8  of the population are adequately met and that state-sponsored

 9  trauma centers will maintain the volume of cases sufficient to

10  provide quality care to trauma cases referred to them.

11         (f)  The availability of qualified health

12  professionals, including physicians and surgeons, capable of

13  staffing trauma centers to the level of current and future

14  assessed needs.

15         (g)  Data collection regarding system operation and

16  patient outcome, as well as the number, type, and generalized

17  locations of state-sponsored trauma centers needed to meet the

18  needs of the population.

19         (h)  Periodic performance evaluation of the trauma

20  system and its components.

21         (i)  The type and extent of air transport services

22  available and needed in each region.

23         (j)  Public information and education about the trauma

24  system.

25         (k)  Emergency medical services communication system

26  usage and dispatching.

27         (l)  The coordination and integration between the

28  trauma centers and other health care facilities which may

29  provide services to trauma victims.

30         (m)  Medical control and accountability.

31         (n)  Quality management and system evaluation.

 1         (2)(3)  The department shall consider the advice and

 2  recommendations of any affected local or regional trauma

 3  agency in developing the state trauma systems plan. The

 4  department may, in lieu of specific regional components of its

 5  own plan, accept components developed by local or regional

 6  trauma agencies.

 7         (3)(4)  The department shall use the state trauma

 8  system plan as the basis for establishing a statewide

 9  inclusive trauma system.

10         Section 2.  Subsection (3) of section 395.402, Florida

11  Statutes, is amended to read:

12         395.402  Trauma service areas; number and location of

13  trauma centers.--

14         (3)  Trauma service areas are to be used. The

15  department shall periodically review the assignment of the 67

16  counties to trauma service areas. These assignments are made

17  for the purpose of developing a system of trauma centers.

18  Revisions made by the department should take into

19  consideration the recommendations made as part of the regional

20  trauma system plans approved by the department, as well as the

21  recommendations made as part of the state trauma system plan.

22  In cases where a trauma service area is located within the

23  boundaries of more than one trauma region, the trauma service

24  area's needs, response capability, and system requirements

25  shall be considered by each trauma region served by that

26  trauma service area in its regional system plan. These areas

27  must, at a minimum, be reviewed in the year 2000 and every 5

28  years thereafter. Until the department completes its initial

29  review, the assignment of counties shall remain as established

30  pursuant to chapter 90-284, Laws of Florida.

 1         (a)  The following trauma service areas are hereby

 2  established:

 3         1.  Trauma service area 1 shall consist of Escambia,

 4  Okaloosa, Santa Rosa, and Walton Counties.

 5         2.  Trauma service area 2 shall consist of Bay, Gulf,

 6  Holmes, and Washington Counties.

 7         3.  Trauma service area 3 shall consist of Calhoun,

 8  Franklin, Gadsden, Jackson, Jefferson, Leon, Liberty, Madison,

 9  Taylor, and Wakulla Counties.

10         4.  Trauma service area 4 shall consist of Alachua,

11  Bradford, Columbia, Dixie, Gilchrist, Hamilton, Lafayette,

12  Levy, Putnam, Suwannee, and Union Counties.

13         5.  Trauma service area 5 shall consist of Baker, Clay,

14  Duval, Nassau, and St. Johns Counties.

15         6.  Trauma service area 6 shall consist of Citrus,

16  Hernando, and Marion Counties.

17         7.  Trauma service area 7 shall consist of Flagler and

18  Volusia Counties.

19         8.  Trauma service area 8 shall consist of Lake,

20  Orange, Osceola, Seminole, and Sumter Counties.

21         9.  Trauma service area 9 shall consist of Pasco and

22  Pinellas Counties.

23         10.  Trauma service area 10 shall consist of

24  Hillsborough County.

25         11.  Trauma service area 11 shall consist of Hardee,

26  Highlands, and Polk Counties.

27         12.  Trauma service area 12 shall consist of Brevard

28  and Indian River Counties.

29         13.  Trauma service area 13 shall consist of DeSoto,

30  Manatee, and Sarasota Counties.

 1         14.  Trauma service area 14 shall consist of Martin,

 2  Okeechobee, and St. Lucie Counties.

 3         15.  Trauma service area 15 shall consist of Charlotte,

 4  Glades, Hendry, and Lee Counties.

 5         16.  Trauma service area 16 shall consist of Palm Beach

 6  County.

 7         17.  Trauma service area 17 shall consist of Collier

 8  County.

 9         18.  Trauma service area 18 shall consist of Broward

10  County.

11         19.  Trauma service area 19 shall consist of Dade and

12  Monroe Counties.

13         (b)  Each trauma service area should have at least one

14  Level I or Level II trauma center. The department shall

15  allocate, by rule, the number of trauma centers needed for

16  each trauma service area.

17         (c)  There shall be no more than a total of 44

18  state-sponsored trauma centers in the state.

19         Section 3.  This act shall take effect July 1, 2004.

24  The Committee Substitute authorizes the continuation of trauma
    services by or in coordination with a trauma agency
25  established before July 1, 2004, in accordance with any public
    or private agreements and operational procedures entered into
26  as provided in s. 395.401
