3     Amendment (with title amendment)
4     Between lines 828 and 829, insert:
5     Section 15.  Subsection (7) of section 400.023, Florida
6Statutes, is amended to read:
7     400.023  Civil enforcement.--
8     (7)  An action under this part for a violation of rights or
9negligence recognized herein is not a claim for medical
10malpractice, and the provisions of s. 768.21(8) do not apply to
11a claim alleging death of the resident.
12     Section 16.  Section 400.0235, Florida Statutes, is amended
13to read:
14     400.0235  Certain provisions not applicable to actions
15under this part.--An action under this part for a violation of
16rights or negligence recognized under this part is not a claim
17for medical malpractice, and the provisions of s. 768.21(8) do
18not apply to a claim alleging death of the resident.
19     Section 17.  Section 400.4295, Florida Statutes, is amended
20to read:
21     400.4295  Certain provisions not applicable to actions
22under this part.--An action under this part for a violation of
23rights or negligence recognized herein is not a claim for
24medical malpractice, and the provisions of s. 768.21(8) do not
25apply to a claim alleging death of the resident.
26     Section 18.  Subsection (8) of section 768.21, Florida
27Statutes, is repealed.

31amending ss. 400.023, 400.0235, and 400.4295, F.S., to conform;
32repealing s. 768.21(8), F.S., relating to limitations on damages
33recoverable by adult children or parents of an adult child for
34wrongful death; providing an effective date.
