3     Amendment to Amendment (807929) (with title amendments)
4Remove line(s) 8-13, and insert:
5     Section 2.  (1)  Notwithstanding the provisions of this
6act, any provision of the Internal Revenue Code of 1986, as
7amended, which took effect on or before January 1, 2004,
8pursuant to the Job and Growth Tax Relief Reconciliation Act of
92003, shall not be included within the meaning of the term
10"Internal Revenue Code," as defined in s. 220.03(1)(n), Florida
11Statutes.
12     (2)  The Department of Revenue shall adopt rules to
13implement the provisions of this section.
14     Section 3.  The sum of $124,800,000, available as a result
15of nonpapplication of the provisions of the Job and Growth Tax
16Relief Reconciliation Act of 2003 under the Florida Income Tax
17Code pursuant to section 2, is appropriated from the General
18Revenue Fund as follows: $55.8 million to the Agency for Health
19Care Administration to fund projected growth in the KidCare
20program for fiscal year 2004-2005; $10 million to provide for
21eligibility under the KidCare program to legal immigrants and
22children of state employees; $31 million to avoid an increase in
23tuition at community colleges; $21 million to avoid increases in
24in-state tuition at state universities; and $6.5 million to
25restore the state portion of Medicaid coverage for adult hearing
26and vision; and $500,000 in additional funding for the FarmShare
27program.
