1 A bill to be entitled
2 An act relating to district school board duties
3 relating to student discipline and school
4 safety; amending s. 1006.07, F.S.; amending
5 requirements relating to codes of student
6 conduct; providing penalties for the use,
7 rather than the possession, of electronic
8 telephone pagers on school property or at a
9 school function; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (d) of subsection (2) of section
14 1006.07, Florida Statutes, is amended to read:
15 1006.07 District school board duties relating to
16 student discipline and school safety.--The district school
17 board shall provide for the proper accounting for all
18 students, for the attendance and control of students at
19 school, and for proper attention to health, safety, and other
20 matters relating to the welfare of students, including:
21 (2) CODE OF STUDENT CONDUCT.--Adopt a code of student
22 conduct for elementary schools and a code of student conduct
23 for middle and high schools and distribute the appropriate
24 code to all teachers, school personnel, students, and parents,
25 at the beginning of every school year. Each code shall be
26 organized and written in language that is understandable to
27 students and parents and shall be discussed at the beginning
28 of every school year in student classes, school advisory
29 council meetings, and parent and teacher association or
30 organization meetings. Each code shall be based on the rules
31 governing student conduct and discipline adopted by the

1 district school board and shall be made available in the
2 student handbook or similar publication. Each code shall
3 include, but is not limited to:
4 (d) Notice that illegal use, possession, or sale of
5 controlled substances, as defined in chapter 893, or the use
6 possession of an electronic telephone pager pagers, by any
7 student while the student is upon school property or in
8 attendance at a school function is grounds for disciplinary
9 action by the school and may also result in criminal penalties
10 being imposed.
11 Section 2. This act shall take effect July 1, 2004.

14 SENATE SUMMARY
15 Requires codes of student conduct to give notice that it
is grounds for disciplinary penalties and for possible
16 criminal penalties if a student uses an electronic
telephone pager while the student is upon school property
17 or in attendance at a school function.
