4 safety; amending s. 1006.07, F.S.; amending
5 requirements relating to codes of student
6 conduct; deleting the notice requirement for
7 possession of an electronic telephone pager
8 while a student is on school property or
9 attending a school function; providing for the
10 possession of wireless communications devices;
11 requiring notice of possible disciplinary
12 action or criminal penalties if a wireless
13 communications device is used in a criminal
14 act; providing for rules by the district school
15 board; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Paragraph (d) of subsection (2) of section
20 1006.07, Florida Statutes, is amended, and present paragraphs
21 (e) through (k) of that subsection are redesignated as
22 paragraphs (f) through (l), respectively, and a new paragraph
23 (e) is added to that subsection, to read:
24 1006.07 District school board duties relating to
25 student discipline and school safety.--The district school
26 board shall provide for the proper accounting for all
27 students, for the attendance and control of students at
28 school, and for proper attention to health, safety, and other
29 matters relating to the welfare of students, including:
30 (2) CODE OF STUDENT CONDUCT.--Adopt a code of student
31 conduct for elementary schools and a code of student conduct

1 for middle and high schools and distribute the appropriate
2 code to all teachers, school personnel, students, and parents,
3 at the beginning of every school year. Each code shall be
4 organized and written in language that is understandable to
5 students and parents and shall be discussed at the beginning
6 of every school year in student classes, school advisory
7 council meetings, and parent and teacher association or
8 organization meetings. Each code shall be based on the rules
9 governing student conduct and discipline adopted by the
10 district school board and shall be made available in the
11 student handbook or similar publication. Each code shall
12 include, but is not limited to:
13 (d) Notice that illegal use, possession, or sale of
14 controlled substances, as defined in chapter 893, or
15 possession of electronic telephone pagers, by any student
16 while the student is upon school property or in attendance at
17 a school function is grounds for disciplinary action by the
18 school and may also result in criminal penalties being
19 imposed.
20 (e) Notice that use of a wireless communications
21 device includes the possibility of the imposition of
22 disciplinary action by the school or criminal penalties if the
23 device is used in a criminal act. A student may possess a
24 wireless communications device while the student is on school
25 property or in attendance at a school function. Each district
26 school board shall adopt rules governing the use of a wireless
27 communications device by a student while the student is on
28 school property or in attendance at a school function.
29 Section 2. This act shall take effect July 1, 2004.
