3     Amendment (with title amendment)
4     Remove line(s) 153-243, and insert:
5     Section 5.  Effective January 4, 2005, section 35.06,
6Florida Statutes, is amended to read:
7     35.06  Organization of district courts of appeal.--A
8district court of appeal shall be organized in each of the five
9appellate districts to be named District Court of Appeal, _____
10District. The number of judges of each district court of appeal
11shall be as follows:
12     (1)  In the first district there shall be 15 judges.
13     (2)  In the second district there shall be 16 14 judges.
14     (3)  In the third district there shall be 11 judges.
15     (4)  In the fourth district there shall be 13 12 judges.
16     (5)  In the fifth district there shall be 11 10 judges.
17     Section 6.  Judges filling new offices created by this act
18shall be appointed by the Governor. In order to implement the
19requirements of s. 3(a), Art. V of the State Constitution that
20each appellate district must have at least one justice appointed
21who is a resident of the district at the time of appointment,
22the Governor shall make appointments so as to bring the court
23into compliance with the State Constitution at the earliest
24opportunity.

29amending s. 35.06, F.S.; increasing the number of judges in
30certain appellate court districts; requiring the Governor to
31make appointments in compliance with the State Constitution;
