71008.22, F.S.; authorizing the SAT and the ACT as
8alternate assessments for the grade 10 FCAT for
9students entering a Florida public school in grade 11
10or grade 12 and for students who have exhausted all
11attempts to pass the grade 10 FCAT; deleting obsolete
12language; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Subsection (9) of section 1008.22, Florida
17Statutes, is amended to read:
18     1008.22  Student assessment program for public schools.--
19     (9)  EQUIVALENCIES FOR STANDARDIZED TESTS.--Any student who
20enters a Florida public school at the eleventh grade or the
21twelfth grade or any student who has exhausted all of his or her
22attempts to pass the grade 10 FCAT and The Commissioner of
23Education shall determine the comparable validity of other
24available standardized tests, including the SAT, ACT, College
25Placement Test, PSAT, PLAN, and tests used for entry into the
26military. If such tests are deemed to be valid and reliable
27measures, the commissioner shall approve the use of such tests
28as alternate assessments to the grade 10 FCAT for the 2002-2003
29school year. Students who attains attain scores on the SAT or
30the ACT that are concordant with equate to the passing scores on
31the grade 10 FCAT for purposes of high school graduation on any
32of the approved alternative assessments shall satisfy the
33assessment requirement for a standard high school diploma as
34provided in s. 1003.429(5)(a) or s. 1003.43(5)(a) for the 2002-
352003 school year graduating class. Prior to the application of
36these alternative assessments in subsequent school years, the
37Legislature shall review the continued use of these alternative
38tests.
39     Section 2.  This act shall take effect upon becoming a law.
