A bill to be entitled
2An act relating to the state executive aircraft pool;
3amending s. 287.161, F.S.; removing limitations on the
4amount charged for aircraft travel and on the deposit and
5use of fees collected; removing an expiration date;
6providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Section 287.161, Florida Statutes, is amended
11to read:
12     287.161  Executive aircraft pool; assignment of aircraft;
13charge for transportation.--
14     (1)  There is created within the Department of Management
15Services an executive aircraft pool consisting of state-owned
16aircraft for the purpose of furnishing executive air travel.
17Such aircraft shall not be a model in excess of a two-engine
18jet. Aircraft included in the executive aircraft pool may not be
19specifically assigned to any department or agency on any basis.
20     (2)  The Department of Management Services shall charge all
21persons receiving transportation from the executive aircraft
22pool a rate not less than the mileage allowance fixed by the
23Legislature for the use of privately owned vehicles. However,
24state employees traveling on a space-available basis may not be
25charged more than the vehicle mileage allowance.
26     (3)  Fees collected for persons traveling by aircraft in
27the executive aircraft pool shall be deposited into the Bureau
28of Aircraft Trust Fund and shall be expended for fuel,
29maintenance, or other costs incurred in accordance with rules
30adopted pursuant to s. 287.16.
31     (2)(4)  Notwithstanding the requirements of subsections (2)
32and (3) and for the 2003-2004 fiscal year only, The Department
33of Management Services shall charge all persons receiving
34transportation from the executive aircraft pool a rate not less
35than the mileage allowance fixed by the Legislature for the use
36of privately owned vehicles. Fees collected for persons
37traveling by aircraft in the executive aircraft pool shall be
38deposited into the Bureau of Aircraft Trust Fund and shall be
39expended for costs incurred to operate the aircraft management
40activities of the department. It is the intent of the
41Legislature that the executive aircraft pool be operated on a
42full cost recovery basis, less available funds. This subsection
43expires July 1, 2004.
44     Section 2.  This act shall take effect July 1, 2004.
