1 A bill to be entitled
2 An act relating to arbitrator compensation;
3 amending s. 44.103, F.S.; increasing the fee
4 cap for arbitrators under court-ordered,
5 nonbinding arbitration; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (3) of section 44.103, Florida
11 Statutes, is amended to read:
12 44.103 Court-ordered, nonbinding arbitration.--
13 (3) Arbitrators shall be selected and compensated in
14 accordance with rules adopted by the Supreme Court.
15 Arbitrators may be compensated by the county or by the
16 parties. Compensation for arbitrators shall not exceed $500
17 $200 per day, unless otherwise agreed by the parties and
18 approved by the court. Whenever possible, qualified
19 individuals who have volunteered their time to serve as
20 arbitrators shall be appointed. If an arbitration program is
21 funded pursuant to s. 44.108, volunteer arbitrators shall be
22 entitled to be reimbursed pursuant to s. 112.061 for all
23 actual expenses necessitated by service as an arbitrator.
24 Section 2. This act shall take effect upon becoming a
25 law.

27 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

30 Reinserts current law but provides for increased
arbitrator fee cap and retains authorization for cap to
31 be exceeded upon agreement by the parties and approval by
the court.
