A bill to be entitled
2An act relating to health; amending and renumbering s.
3216.341, F.S.; exempting Department of Health positions
4funded by certain trust funds from certain authorization
5provisions; amending s. 381.0066, F.S.; extending the
6period for a certain additional fee for purposes of
7research on onsite sewage treatment and disposal systems;
8amending s. 385.207, F.S.; correcting the name of a
9certain official; continuing use of the Epilepsy Services
10Trust Fund for epilepsy case management services; limiting
11administrative expenditure from the fund; creating s.
12391.310, F.S.; creating the Florida Infants and Toddlers
13Early Intervention Program; requiring the Department of
14Health to work with other agencies to implement a certain
15federal program; amending s. 464.0195, F.S.; providing for
16a portion of nursing licensure renewal fees to fund the
17Florida Center for Nursing; providing a prohibition on
18increasing the renewal fee beyond a certain level;
19providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Section 216.341, Florida Statutes, is
24renumbered as section 216.2625, Florida Statutes, and amended to
25read:
26     216.2625 216.341  Disbursement of Department of Health
27county health department trust funds; appropriation of
28authorized positions.--
29     (1)  Funds from the County Health Department Trust Fund
30County health department trust funds may be expended by the
31Department of Health for the respective county health
32departments in accordance with budgets and plans agreed upon by
33the county authorities of each county and the Department of
34Health.
35     (2)  The requirements limitations on appropriations
36provided in s. 216.262(1) that the total number of authorized
37positions must be appropriated shall not apply to Department of
38Health positions funded by:
39     (a)  The County Health Department Trust Fund; or County
40health department trust funds
41     (b)  The United States Trust Fund.
42     Section 2.  Paragraph (k) of subsection (2) of section
43381.0066, Florida Statutes, is amended to read:
44     381.0066  Onsite sewage treatment and disposal systems;
45fees.--
46     (2)  The minimum fees in the following fee schedule apply
47until changed by rule by the department within the following
48limits:
49     (k)  Research: An additional $5 fee shall be added to each
50new system construction permit issued during fiscal years 1996-
512004 to be used to fund for onsite sewage treatment and disposal
52system research, demonstration, and training projects. Five
53dollars from any repair permit fee collected under this section
54shall be used for funding the hands-on training centers
55described in s. 381.0065(3)(j).

57The funds collected pursuant to this subsection must be
58deposited in a trust fund administered by the department, to be
59used for the purposes stated in this section and ss. 381.0065
60and 381.00655.
61     Section 3.  Paragraph (a) of subsection (2) and subsection
62(6) of section 385.207, Florida Statutes, are amended, and
63subsection (7) is added to said section, to read:
64     385.207  Care and assistance of persons with epilepsy;
65establishment of programs in epilepsy control.--
66     (2)  The Department of Health shall:
67     (a)  Establish within the office of the Deputy State Health
68Officer Assistant Secretary for Health a program for the care
69and assistance of persons with epilepsy and promote and assist
70in the continued development and expansion of programs for the
71case management, diagnosis, care, and treatment of such persons,
72including required pharmaceuticals, medical procedures, and
73techniques which will have a positive effect in the care and
74treatment of persons with epilepsy.
75     (6)  For the 2003-2004 fiscal year only, Funds in the
76Epilepsy Services Trust Fund may be appropriated for epilepsy
77case management services. This subsection expires July 1, 2004.
78     (7)  The department shall limit any administrative
79expenditure from the Epilepsy Services Trust Fund to 5 percent
80of annual receipts.
81     Section 4.  Section 391.310, Florida Statutes, is created
82to read:
83     391.310  Florida Infants and Toddlers Early Intervention
84Program.--The Department of Health is authorized to implement
85and administer part C of the federal Individuals with
86Disabilities Education Act, which shall be known as the "Florida
87Infants and Toddlers Early Intervention Program."
88     (1)  The department, jointly with the Department of
89Education, shall prepare annually a grant application to the
90United States Department of Education for funding for early
91intervention services for infants and toddlers with
92disabilities, ages birth through 36 months, and their families
93pursuant to part C of the federal Individuals with Disabilities
94Education Act.
95     (2)  The department, jointly with the Department of
96Education, shall include a reading initiative as an early
97intervention service for infants and toddlers.
98     Section 5.  Subsection (3) of section 464.0195, Florida
99Statutes, is amended to read:
100     464.0195  Florida Center for Nursing; goals.--
101     (3)  The Board of Nursing shall designate no more than $5
102of each renewal fee received as include on its initial and
103renewal application forms a question asking the nurse to
104voluntarily contribute to funding for the Florida Center for
105Nursing; however, in no event may such designation be used to
106increase the renewal fee beyond that in place on May 1, 2004.
107The designated funds in addition to paying the fees imposed at
108the time of licensure and licensure renewal. Revenues collected
109from nurses over and above the required fees shall be deposited
110in the Florida Center for Nursing Trust Fund and shall be used
111solely to support and maintain the goals and functions of the
112center.
113     Section 6.  This act shall take effect July 1, 2004.
