5 | Section 5. Notwithstanding section 849.0931, Florida |
6 | Statutes, bingo games for residents or clients of facilities |
7 | licensed or authorized under part II, part III, or part V of |
8 | chapter 400, Florida Statutes, chapter 651, Florida Statutes, or |
9 | section 430.206, Florida Statutes, and for their guests, or for |
10 | residents of government-financed, government-insured, or |
11 | government-subsidized housing for the elderly and their guests, |
12 | may be conducted if such games are held in the facility, played |
13 | exclusively by residents or clients and their guests, and |
14 | conducted by residents, staff, or volunteers of the facility, |
15 | and if neither the facility nor any third party derives |
16 | financial benefit from such games. Games conducted in a facility |
17 | licensed under part II, part III, or part V of chapter 400, |
18 | Florida Statutes, for residents or clients with a diagnosis of |
19 | Alzheimer's disease or a related dementia may not be played with |
20 | the personal funds of residents or clients and must be |
21 | supervised by paid or volunteer staff. Prizes may be claimed |
22 | only by residents or clients of these facilities or by guests |
23 | who are residents or clients of other similarly licensed or |
24 | authorized facilities. Net proceeds must be returned to players |
25 | in the form of prizes after expenses for refreshments and bingo |
26 | supplies are deducted. Any county or municipality that regulates |
27 | the playing of bingo shall exempt bingo games conducted pursuant |
28 | to this section from regulation and fees. |
