1 A bill to be entitled
2 An act relating to registered professionals;
3 amending s. 373.117, F.S.; providing
4 requirements for certification by appropriate
5 registered professionals of water resource
6 activities for which a permit or license and
7 such certification are required; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 373.117, Florida Statutes, is
13 amended to read:
14 373.117 Certification by appropriate registered
15 professionals professional engineer.--
16 (1) If an application for a permit or license to
17 conduct an activity regulated under this chapter requires the
18 services of appropriate registered professionals a
19 professional engineer as regulated and defined by law chapter
20 471, the department or governing board of a water management
21 district may require, as a condition of granting a permit or
22 license, that one or more professionals a professional
23 engineer licensed under law chapter 471 certify upon
24 completion of the permitted or licensed activity that such
25 activity has been completed in substantial conformance with
26 the plans and specifications approved by the department or
27 board.
28 (2) The cost of such certification by appropriate
29 registered professionals a professional engineer shall be
30 borne by the permittee.

1 (3) No permitted or licensed activity which is
2 required to be so certified shall be placed into use or
3 operation until the appropriate registered professionals'
4 certificates or seals and signatures are professional
5 engineer's certificate is filed with the department or board.
6 Section 2. This act shall take effect upon becoming a
7 law.

9 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
10 Senate Bill 1878

12 The committee substitute deletes language that included
professional geologists in the provision of the Consultants
13 Competitive Negotiation Act. It changes the provision that
added professional geologists to the types of services
14 required for certification of any activity regulated under the
Florida Water Resources Act of 1972. The commmittee
15 substitute now provides that the services may be performed by
"appropriate registered professionals."
