1 A bill to be entitled
2 An act relating to a public records exemption;
3 amending s. 119.07; providing an exemption from
4 public records requirements for the home
5 addresses, telephone numbers, social security
6 numbers, and photographs of active or former
7 emergency medical technicians or paramedics
8 certified in compliance with ch. 401, F.S., the
9 home addresses, telephone numbers, social
10 security numbers, photographs, and places of
11 employment of the spouses and the children of
12 such emergency medical technicians and
13 paramedics, and the names and locations of
14 schools and day care facilities attended by
15 children of such emergency medical technicians
16 and paramedics; providing for future review and
17 repeal of the exemption; providing a statement
18 of public necessity; providing an effective
19 date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Paragraph (i) of subsection (3) of section
24 119.07, Florida Statutes, is amended to read:
25 119.07 Inspection, examination, and duplication of
26 records; exemptions.--
27 (3)
28 (i)1. The home addresses, telephone numbers, social
29 security numbers, and photographs of active or former law
30 enforcement personnel, including correctional and correctional
31 probation officers, personnel of the Department of Children

1 and Family Services whose duties include the investigation of
2 abuse, neglect, exploitation, fraud, theft, or other criminal
3 activities, personnel of the Department of Health whose duties
4 are to support the investigation of child abuse or neglect,
5 and personnel of the Department of Revenue or local
6 governments whose responsibilities include revenue collection
7 and enforcement or child support enforcement; the home
8 addresses, telephone numbers, social security numbers,
9 photographs, and places of employment of the spouses and
10 children of such personnel; and the names and locations of
11 schools and day care facilities attended by the children of
12 such personnel are exempt from the provisions of subsection
13 (1). The home addresses, telephone numbers, and photographs of
14 firefighters certified in compliance with s. 633.35; the home
15 addresses, telephone numbers, photographs, and places of
16 employment of the spouses and children of such firefighters;
17 and the names and locations of schools and day care facilities
18 attended by the children of such firefighters are exempt from
19 subsection (1). The home addresses, telephone numbers, social
20 security numbers, and photographs of active or former
21 emergency medical technicians or paramedics certified in
22 compliance with chapter 401; the home addresses, telephone
23 numbers, social security numbers, photographs, and places of
24 employment of the spouses and children of such emergency
25 medical technicians and paramedics; and the names and
26 locations of schools and day care facilities attended by
27 children of such emergency medical technicians and paramedics
28 are exempt from subsection (1) and s. 24(a), Art. I of the
29 State Constitution. The home addresses and telephone numbers
30 of justices of the Supreme Court, district court of appeal
31 judges, circuit court judges, and county court judges; the

1 home addresses, telephone numbers, and places of employment of
2 the spouses and children of justices and judges; and the names
3 and locations of schools and day care facilities attended by
4 the children of justices and judges are exempt from the
5 provisions of subsection (1). The home addresses, telephone
6 numbers, social security numbers, and photographs of current
7 or former state attorneys, assistant state attorneys,
8 statewide prosecutors, or assistant statewide prosecutors; the
9 home addresses, telephone numbers, social security numbers,
10 photographs, and places of employment of the spouses and
11 children of current or former state attorneys, assistant state
12 attorneys, statewide prosecutors, or assistant statewide
13 prosecutors; and the names and locations of schools and day
14 care facilities attended by the children of current or former
15 state attorneys, assistant state attorneys, statewide
16 prosecutors, or assistant statewide prosecutors are exempt
17 from subsection (1) and s. 24(a), Art. I of the State
18 Constitution.
19 2. The home addresses, telephone numbers, social
20 security numbers, and photographs of current or former human
21 resource, labor relations, or employee relations directors,
22 assistant directors, managers, or assistant managers of any
23 local government agency or water management district whose
24 duties include hiring and firing employees, labor contract
25 negotiation, administration, or other personnel-related
26 duties; the names, home addresses, telephone numbers, social
27 security numbers, photographs, and places of employment of the
28 spouses and children of such personnel; and the names and
29 locations of schools and day care facilities attended by the
30 children of such personnel are exempt from subsection (1) and
31 s. 24(a), Art. I of the State Constitution. This subparagraph

1 is subject to the Open Government Sunset Review Act of 1995 in
2 accordance with s. 119.15, and shall stand repealed on October
3 2, 2006, unless reviewed and saved from repeal through
4 reenactment by the Legislature.
5 3. The home addresses, telephone numbers, social
6 security numbers, and photographs of current or former code
7 enforcement officers; the names, home addresses, telephone
8 numbers, social security numbers, photographs, and places of
9 employment of the spouses and children of such persons; and
10 the names and locations of schools and day care facilities
11 attended by the children of such persons are exempt from
12 subsection (1) and s. 24(a), Art. I of the State Constitution.
13 This subparagraph is subject to the Open Government Sunset
14 Review Act of 1995 in accordance with s. 119.15, and shall
15 stand repealed on October 2, 2006, unless reviewed and saved
16 from repeal through reenactment by the Legislature.
17 4. An agency that is the custodian of the personal
18 information specified in subparagraph 1., subparagraph 2., or
19 subparagraph 3. and that is not the employer of the officer,
20 employee, justice, judge, or other person specified in
21 subparagraph 1., subparagraph 2., or subparagraph 3. shall
22 maintain the confidentiality of the personal information only
23 if the officer, employee, justice, judge, other person, or
24 employing agency of the designated employee submits a written
25 request for confidentiality to the custodial agency.
26 Section 2. Subparagraph 1. of paragraph (i) of
27 subsection (3) of section 119.07, Florida Statutes, is subject
28 to the Open Government Sunset Review Act of 1995 in accordance
29 with section 119.15, Florida Statutes, and shall stand
30 repealed on October 2, 2009, unless reviewed and saved from
31 repeal through reenactment by the Legislature.

1 Section 3. The Legislature finds that the exemption
2 from public records requirements provided for by this act for
3 the home addresses, telephone numbers, social security
4 numbers, and photographs of active or former emergency medical
5 technicians or paramedics certified in compliance with chapter
6 401, Florida Statutes, the home addresses, telephone numbers,
7 social security numbers, photographs, and places of employment
8 of the spouses and the children of such emergency medical
9 technicians and paramedics, and the names and locations of
10 schools and day care facilities attended by children of such
11 emergency medical technicians and paramedics is a public
12 necessity. This exemption is justified because if such
13 information were not confidential, an emergency medical
14 technician or paramedic or a member or members of his or her
15 family could be harmed or threatened with harm by an
16 individual, or a family member of such individual, who was
17 provided emergency medical care which resulted in a negative
18 outcome.
19 Section 4. This act shall take effect upon becoming a
20 law.
