2An act relating to criminal offenses; providing a popular
3name; creating s. 775.0847, F.S.; providing for
4reclassification of felony offenses committed against
5persons 65 years of age or older, elderly persons, and
6disabled adults; amending s. 784.08, F.S.; providing for
7the reclassification of misdemeanor assault and battery
8offenses when committed against persons 65 years of age or
9older; deleting provisions related to the reclassification
10of the felony offenses of aggravated assault and
11aggravated battery when committed against persons 65 years
12of age or older, to conform; amending s. 812.0145, F.S.;
13providing for a mandatory term of imprisonment upon
14conviction of certain theft offenses when committed
15against persons 65 years of age or older; amending s.
16825.103, F.S.; providing for a mandatory term of
17imprisonment upon conviction of certain acts of
18exploitation against an elderly person or disabled adult;
19amending ss. 775.0877 and 921.0022, F.S.; revising cross
20references, to conform; providing applicability; providing
21an effective date.

23Be It Enacted by the Legislature of the State of Florida:
24
25     Section 1.  This act shall be known by the popular name the
26"Seniors' Safety Act."
27     Section 2.  Section 775.0847, Florida Statutes, is created
28to read:
29     775.0847  Felony offenses committed against the elderly or
30disabled; reclassification of offenses.--Whenever a person is
31charged with committing a felony offense upon a person who is 65
32years of age or older or who is an elderly person or disabled
33adult, as those terms are defined in s. 825.101, regardless of
34whether the person charged knew or had reason to know of the
35age, infirmity, or disability of the victim, the offense for
36which the person is charged shall be reclassified as follows:
37     (1)  In the case of a felony of the third degree, the
38offense is reclassified to a felony of the second degree.
39     (2)  In the case of a felony of the second degree, the
40offense is reclassified to a felony of the first degree.
41     (3)  In the case of a felony of the first degree, the
42offense is reclassified to a felony of the first degree,
43punishable by life imprisonment.
44     Section 3.  Subsection (2) of section 784.08, Florida
45Statutes, is amended to read:
46     784.08  Assault or battery on persons 65 years of age or
47older; reclassification of offenses; minimum sentence.--
48     (2)  Whenever a person is charged with committing an
49assault or aggravated assault or a battery or aggravated battery
50upon a person 65 years of age or older, regardless of whether he
51or she knows or has reason to know the age of the victim, the
52offense for which the person is charged shall be reclassified as
53follows:
54     (a)  In the case of aggravated battery, from a felony of
55the second degree to a felony of the first degree.
56     (b)  In the case of aggravated assault, from a felony of
57the third degree to a felony of the second degree.
58     (a)(c)  In the case of battery, from a misdemeanor of the
59first degree to a felony of the third degree.
60     (b)(d)  In the case of assault, from a misdemeanor of the
61second degree to a misdemeanor of the first degree.
62     Section 4.  Section 812.0145, Florida Statutes, is amended
63to read:
64     812.0145  Theft from persons 65 years of age or older;
65penalties reclassification of offenses.--
66     (1)  A person who is convicted of theft of more than $1,000
67from a person 65 years of age or older shall be ordered by the
68sentencing judge to make restitution to the victim of such
69offense and to perform up to 500 hours of community service
70work. Restitution and community service work shall be in
71addition to any fine or sentence which may be imposed and shall
72not be in lieu thereof.
73     (2)  Notwithstanding any other provision of law, if the
74funds, assets, or property involved in a theft from a person 65
75years of age or older is valued at $10,000 or more, the court
76shall sentence the offender to a mandatory minimum term of
77imprisonment of 3 years. However, this mandatory minimum term of
78imprisonment does not apply to the theft of one or more motor
79vehicles, regardless of associated value. Whenever a person is
80charged with committing theft from a person 65 years of age or
81older, when he or she knows or has reason to believe that the
82victim was 65 years of age or older, the offense for which the
83person is charged shall be reclassified as follows:
84     (a)  This subsection does not prevent a court from imposing
85a greater sentence of incarceration as authorized by law If the
86funds, assets, or property involved in the theft from a person
8765 years of age or older is valued at $50,000 or more, the
88offender commits a felony of the first degree, punishable as
89provided in s. 775.082, s. 775.083, or s. 775.084.
90     (b)  If the mandatory minimum term of imprisonment imposed
91under this subsection exceeds the maximum sentence authorized by
92s. 775.082, s. 775.084, or the Criminal Punishment Code under
93chapter 921, the mandatory minimum term of imprisonment must be
94imposed. If the mandatory minimum term of imprisonment under
95this subsection is less than the sentence that could be imposed
96as authorized by s. 775.082, s. 775.084, or the Criminal
97Punishment Code under chapter 921, the sentence imposed by the
98court must include the mandatory minimum term of imprisonment as
99required in this subsection If the funds, assets, or property
100involved in the theft from a person 65 years of age or older is
101valued at $10,000 or more, but less than $50,000, the offender
102commits a felony of the second degree, punishable as provided in
103s. 775.082, s. 775.083, or s. 775.084.
104     (c)  If the funds, assets, or property involved in the
105theft from a person 65 years of age or older is valued at $300
106or more, but less than $10,000, the offender commits a felony of
107the third degree, punishable as provided in s. 775.082, s.
108775.083, or s. 775.084.
109     Section 5.  Subsections (3) and (4) are added to section
110825.103, Florida Statutes, to read:
111     825.103  Exploitation of an elderly person or disabled
112adult; penalties.--
113     (3)  Notwithstanding any other provision of law, if the
114funds, assets, or property involved in the exploitation of an
115elderly person or a disabled adult is valued at $10,000 or more,
116the court shall sentence the offender to a mandatory minimum
117term of imprisonment of 3 years.
118     (4)  This section does not prevent a court from imposing a
119greater sentence of incarceration as authorized by law. If the
120mandatory minimum term of imprisonment imposed pursuant to
121subsection (3) exceeds the maximum sentence authorized by s.
122775.082, s. 775.084, or the Criminal Punishment Code under
123chapter 921, the mandatory minimum term of imprisonment must be
124imposed. If the mandatory minimum term of imprisonment under
125this section is less than the sentence that could be imposed as
126authorized by s. 775.082, s. 775.084, or the Criminal Punishment
127Code under chapter 921, the sentence imposed by the court must
128include the mandatory minimum term of imprisonment as required
129in subsection (3).
130     Section 6.  Subsection (1) of section 775.0877, Florida
131Statutes, is amended to read:
132     775.0877  Criminal transmission of HIV; procedures;
133penalties.--
134     (1)  In any case in which a person has been convicted of or
135has pled nolo contendere or guilty to, regardless of whether
136adjudication is withheld, any of the following offenses, or the
137attempt thereof, which offense or attempted offense involves the
138transmission of body fluids from one person to another:
139     (a)  Section 794.011, relating to sexual battery,
140     (b)  Section 826.04, relating to incest,
141     (c)  Section 800.04(1), (2), and (3), relating to lewd,
142lascivious, or indecent assault or act upon any person less than
14316 years of age,
144     (d)  Sections 784.011, 784.07(2)(a), and 784.08(2)(b)(d),
145relating to assault,
146     (e)  Sections 784.021 and, 784.07(2)(c), and 784.08(2)(b),
147relating to aggravated assault,
148     (f)  Sections 784.03, 784.07(2)(b), and 784.08(2)(a)(c),
149relating to battery,
150     (g)  Sections 784.045 and, 784.07(2)(d), and 784.08(2)(a),
151relating to aggravated battery,
152     (h)  Section 827.03(1), relating to child abuse,
153     (i)  Section 827.03(2), relating to aggravated child abuse,
154     (j)  Section 825.102(1), relating to abuse of an elderly
155person or disabled adult,
156     (k)  Section 825.102(2), relating to aggravated abuse of an
157elderly person or disabled adult,
158     (l)  Section 827.071, relating to sexual performance by
159person less than 18 years of age,
160     (m)  Sections 796.03, 796.07, and 796.08, relating to
161prostitution, or
162     (n)  Section 381.0041(11)(b), relating to donation of
163blood, plasma, organs, skin, or other human tissue,

165the court shall order the offender to undergo HIV testing, to be
166performed under the direction of the Department of Health in
167accordance with s. 381.004, unless the offender has undergone
168HIV testing voluntarily or pursuant to procedures established in
169s. 381.004(3)(h)6. or s. 951.27, or any other applicable law or
170rule providing for HIV testing of criminal offenders or inmates,
171subsequent to her or his arrest for an offense enumerated in
172paragraphs (a)-(n) for which she or he was convicted or to which
173she or he pled nolo contendere or guilty. The results of an HIV
174test performed on an offender pursuant to this subsection are
175not admissible in any criminal proceeding arising out of the
176alleged offense.
177     Section 7.  Paragraphs (c) through (g) of subsection (3) of
178section 921.0022, Florida Statutes, are amended to read:
