  2         An act relating to state vehicles; amending s.

  3         287.17, F.S.; providing that the term "official

  4         state business" shall be construed to permit

  5         the use of state vehicles by law enforcement

  6         officers for going to and from lunch breaks and

  7         incidental stops for personal errands; creating

  8         s. 284.311, F.S.; providing reimbursement for

  9         certain off-duty use; providing for rules;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (3) of section 287.17, Florida

15  Statutes, is amended to read:

16         287.17  Limitation on use of motor vehicles and

17  aircraft.--

18         (3)(a)  The term "official state business" may not be

19  construed to permit the use of a motor vehicle or aircraft for

20  commuting purposes, unless special assignment of a motor

21  vehicle is authorized as a perquisite by the Department of

22  Management Services, required by an employee after normal duty

23  hours to perform duties of the position to which assigned, or

24  authorized for an employee whose home is the official base of

25  operation.

26         (b)  For motor vehicles used by a state employee whose

27  duties are those of a law enforcement officer, as defined in

28  s. 943.10, the term "official state business" shall be

29  construed to permit the use of the vehicle during normal duty

30  hours to and from lunch or meal breaks and incidental stops

31  for personal errands, but not substantial deviations from

 1  official state business, if such use is at the direction of or

 2  with the permission of the agency head.

 3         Section 2.  Section 284.311, Florida Statutes, is

 4  created to read:

 5         284.311  Property damage coverage for state-owned

 6  vehicles.--If a state employee whose duties are those of a law

 7  enforcement officer, as defined in s. 943.10, uses the motor

 8  vehicle for off-duty work for which he or she must reimburse

 9  the state, that reimbursement must include a reimbursement for

10  property damage coverage on the motor vehicle while it is used

11  for the off-duty work. The Division of Risk Management within

12  the Department of Financial Services shall adopt rules

13  assessing the amount of such reimbursement for the actual

14  costs of coverage associated with off-duty coverage and may

15  adopt rules that provide for a deductible in an amount of not

16  more than $500 per incident when the employee is determined to

17  be at fault in the incident and was using the motor vehicle in

18  approved activities for which he or she was liable to

19  reimburse the state.

20         Section 3.  This act shall take effect July 1, 2004.
