3 | A resolution requesting the Congressional Delegation of |
4 | the State of Florida to support federal legislation to end |
5 | the abuse of tort laws against the firearms industry. |

7 | WHEREAS, citizens have a right, protected by the Second |
8 | Amendment to the United States Constitution, to keep and bear |
9 | arms, and |
10 | WHEREAS, lawsuits have been commenced against |
11 | manufacturers, distributors, dealers, and importers of firearms |
12 | that operate as designed and intended, which seek money damages |
13 | and other relief for the harm caused by the misuse of firearms |
14 | by third parties, including criminals, and |
15 | WHEREAS, the manufacture, importation, possession, sale, |
16 | and use of firearms and ammunition in the United States are |
17 | heavily regulated by federal, state, and local laws, including |
18 | the Gun Control Act of 1968, the National Firearms Act, and the |
19 | Arms Export Control Act, and |
20 | WHEREAS, businesses in the United States that are engaged |
21 | in interstate and foreign commerce through the lawful design, |
22 | manufacture, marketing, distribution, importation, or sale to |
23 | the public of firearms or ammunition that has been shipped or |
24 | transported in interstate or foreign commerce are not, and |
25 | should not, be liable for the harm caused by those who |
26 | criminally or unlawfully misuse firearm or ammunition products |
27 | that function as designed and intended, and |
28 | WHEREAS, thirty-three states have passed legislation |
29 | protecting firearms and ammunition manufacturers, H.R. 1036 |
30 | passed the United States House of Representatives in an |
31 | overwhelming bipartisan vote of 285 to 140, and S. 659 has |
32 | fifty-five cosponsors in the United States Senate, NOW, |
33 | THEREFORE, |

35 | Be It Resolved by the House of Representatives of the State of |
36 | Florida: |

38 | That the House of Representatives of the State of Florida |
39 | requests our elected Representatives and Senators in the United |
40 | States Congress to support federal legislation to end the abuse |
41 | of tort laws against the firearms industry. |
42 | BE IT FURTHER RESOLVED that copies of this resolution be |
43 | transmitted to the members of the Congressional Delegation of |
44 | the State of Florida. |
