House Resolution
3A resolution requesting the Congressional Delegation of
4the State of Florida to support federal legislation to end
5the abuse of tort laws against the firearms industry.

7     WHEREAS, citizens have a right, protected by the Second
8Amendment to the United States Constitution, to keep and bear
9arms, and
10     WHEREAS, lawsuits have been commenced against
11manufacturers, distributors, dealers, and importers of firearms
12that operate as designed and intended, which seek money damages
13and other relief for the harm caused by the misuse of firearms
14by third parties, including criminals, and
15     WHEREAS, the manufacture, importation, possession, sale,
16and use of firearms and ammunition in the United States are
17heavily regulated by federal, state, and local laws, including
18the Gun Control Act of 1968, the National Firearms Act, and the
19Arms Export Control Act, and
20     WHEREAS, businesses in the United States that are engaged
21in interstate and foreign commerce through the lawful design,
22manufacture, marketing, distribution, importation, or sale to
23the public of firearms or ammunition that has been shipped or
24transported in interstate or foreign commerce are not, and
25should not, be liable for the harm caused by those who
26criminally or unlawfully misuse firearm or ammunition products
27that function as designed and intended, and
28     WHEREAS, thirty-three states have passed legislation
29protecting firearms and ammunition manufacturers, H.R. 1036
30passed the United States House of Representatives in an
31overwhelming bipartisan vote of 285 to 140, and S. 659 has
32fifty-five cosponsors in the United States Senate, NOW,
33THEREFORE,

35Be It Resolved by the House of Representatives of the State of
36Florida:

38     That the House of Representatives of the State of Florida
39requests our elected Representatives and Senators in the United
40States Congress to support federal legislation to end the abuse
41of tort laws against the firearms industry.
42     BE IT FURTHER RESOLVED that copies of this resolution be
43transmitted to the members of the Congressional Delegation of
44the State of Florida.
