1 A bill to be entitled
2          An act relating to instructional materials for K-12 public
3    education; authorizing the Department of Education to
4    conduct a pilot program; authorizing a pilot program
5    within specified counties to enable selected school
6    districts to realize cost savings in the purchase of used
7    instructional materials; imposing requirements on the
8    vendors of such materials; absolving the state from
9    responsibility for certain financial losses; requiring the
10    Council for Education Policy Research and Improvement to
11    report to the Legislature; providing for future repeal;
12    providing an effective date.

14          Be It Enacted by the Legislature of the State of Florida:
15         
16          Section 1. Notwithstanding section 1006.37, Florida
17    Statutes, the Department of Education may conduct a pilot
18    program to enable selected school districts to realize cost
19    savings without loss of quality or availability for individual
20    students in the purchase of used instructional materials. The
21    school districts of Hernando County, Pasco County, and Polk
22    County may participate in the pilot program. Charter schools in
23    those school districts may also participate in the pilot
24    program. When a secondhand book dealer or other third-party book
25    vendor provides used adopted instructional materials to a school
26    district, the dealer or vendor must certify the availability of
27    the used instructional materials, provide the International
28    Standard Book Number of each of the used instructional
29    materials, and certify that such materials are not samples or
30    first printings, are the most currently adopted, Florida-
31    specific instructional materials, and conform to the Sunshine
32    State Standards. The state is not responsible for financial loss
33    caused by the school district’s deviating from the requirements
34    of section 1006.37, Florida Statutes. The Council for Education
35    Policy Research and Improvement shall submit to the President of
36    the Senate and the Speaker of the House of Representatives for
37    consideration during the 2005 Regular Session a report of the
38    cost savings to school districts based on results of the pilot
39    program. This section is repealed July 1, 2007.
40          Section 2. This act shall take effect July 1, 2004.
