7An act relating to instructional materials for K-12 public
8education; authorizing the Department of Education to
9conduct a pilot program within specified counties to
10enable selected school districts to realize cost savings
11in the purchase of used instructional materials; imposing
12requirements on the vendors of such materials; absolving
13the state from responsibility for certain financial
14losses; requiring the Council for Education Policy
15Research and Improvement to report to the Legislature;
16providing for future repeal; providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  Notwithstanding section 1006.37, Florida
21Statutes, the Department of Education may conduct a pilot
22program to enable selected school districts to realize cost
23savings without loss of quality or availability for individual
24students in the purchase of used instructional materials. This
25program is limited to the counties of Hernando, Pasco, and Polk.
26Charter schools in those school districts may also participate
27in the pilot program. When a secondhand book dealer or other
28third-party book vendor provides used adopted instructional
29materials to a school district, the dealer or vendor must
30certify the availability of the used instructional materials,
31provide the International Standard Book Number of each of the
32used instructional materials, and certify that such materials
33are not samples or first printings, are the most currently
34adopted, Florida-specific instructional materials, and conform
35to the Sunshine State Standards. The state is not responsible
36for financial loss caused by the school district's deviating
37from the requirements of section 1006.37, Florida Statutes. The
38Council for Education Policy Research and Improvement shall
39submit to the President of the Senate and the Speaker of the
40House of Representatives for consideration during the 2005
41Regular Session a report of the cost savings to school districts
42based on results of the pilot program. This section is repealed
43July 1, 2007.
44     Section 2.  This act shall take effect July 1, 2004.
